Minnesota Football Players Involved In Sexual Assault Investigation Sue School For $45 Million

Nick Martin

June 8, 2018 4:47pm

Nine of the 10 Minnesota football players who were temporarily or permanently suspended at the conclusion of a 2016 university sexual assault investigation are suing the school for $5 million apiece.

The lawsuit claims Minnesota exhibited “intentional discrimination based on Plaintiffs’ race and gender” during the school’s investigation of a September 2016 reported sexual assault. An initial investigation by Minneapolis police did not result in any charges because they felt they didn’t have a winnable case, but an investigation by the university’s EEOC department resulted in the suspension of the 10 involved players, with five recommended for expulsion.

The two investigations took two fairly different approaches. The university investigation cited text messages sent by the players throughout its report while the police’s supplemental reports skipped them completely; the university investigators also interviewed 28 people, as opposed to the police department’s list of 10.

Five of the players were eventually reinstated after filing appeals, while four of the remaining five had their expulsions upheld; the remaining player had his expulsion reduced to a one-year suspension. Three players are on the roster for the upcoming 2018 season. An external panel concluded last fall that Minnesota’s EEOC team followed protocol in its investigation.

The lawyer representing the players, Dave Madgett, told ESPN that the university was biased, claiming it displayed “this arcane belief that these guys are just testosterone-filled guys,” throughout its investigation. He then cited the fact that the woman in the case matched with one of the players on the dating app Tinder as evidence that the following group sex acts were consensual. He said the legal team chose not to include the woman in the lawsuit because he believes, “she got caught up,” reasoning that she woke up the next morning and went through the entire sexual assault reporting process with police solely because she felt like she “didn’t make some great choices.” He added, while discussing the male-football-player bias, “I can’t explain it any other way.”

Wow, this stuff just never ends. So because the woman hooked up with one of the players on tinder, it was OK for numerous other players to pull a train on her? Hard to believe that in the current climate this will go well for the gophs, but who knows. If they get a friendly local jury with a bunch of fans on there.......

You wouldn't think stuff like this would help recruiting, but so far it doesn't seem to have effected Michigan State's with all the crap going on over there.

I'd have to agree. As a parent of two sons who played college basketball, I really have to wonder about parents who seem to have no concern at all about sending their offspring to any school that appears to have a total disregard for the safety and nurturing of their students, and those they come in contact with. I mean really, if they gloss over the issues we've heard so much about, at schools like MSU, PSU, Baylor, and Minnesota, then what else are they willing to sweep under the rug, all in an effort to protect, (their supposed) good name?

Good. The kangaroo courts a university runs in relation to these types of accusations needs to end

Some people will buy into anything that being sold, and some can be be bought for relatively small dollars. Those that go to these places deserve what they get.

Well, for one, four of the players were reinstated after having their faces printed in the star and trib as not being part of it. Some weren't even in the building. It's always nice to be called a rapist and have your photo in the paper when you weren't even there and had nothing to do with it. Winfield's kid was one of them.

Second, the police have an entirely different thought on what happened based on video evidence that was allowed for the police but not by the genius Minnesota EEOA or whatever the hell it is.

I do find it funny that my liberal based university that does everything based on the EEOA is now being sued for racism. In other words, the liberalism they worship is now being turned on them and the liberalism they worship is being thrown right back in their face with racism as the charge.

I am hoping the police case allows more info to come out and some of you will be eating crow. Sort of like your regional basketball powerhouse you were going to have last year along with your 4-5 football challenging for the west. You're used to the crow, so it won't be a big deal.

By the way, Reusse will have an article on this! LMAO

It isn't nothing to see here. It is a university smearing a number of men without due process

This was never really a legal issue, once the police investigated. No way if that case goes to a jury they get a conviction. The whole behavior is another matter. Multiple people having sex with the same girl, all with a recruit involved? Yes, call me a prude but my goodness if those are the type of folks coming into the program I wouldn't want my kid within 1,000 miles of it.

She had sex with the 17 year old and his player in charge of watching him willingly. She then was ok with the train starting. This was not her first train.

Why wasn't she kicked of the cheerleading team? Hell, she went to the bowl game and was leading the cheerleaders in the parade for the game.

You can't make it up.

Again sir, 4 of these players had their photo in the paper as rapists and they weren't even in the building. Any comments on that? Didn't think so.

Thats great. So you know for a FACT that she was OK with "THE TRAIN"? And you think its good upstanding behavior for a young man to jump on in as number five or whatever? Very good, thanks for your input. Please do keep coming back and defending this type of abhorant behavior.

She was okay with the train starting? Are you serious? Who is your source? And this was not her first train? Again, who is your source? Now it is you who is smearing the alleged victim with no backup. We are just supposed to take your word for it. Yeah, like that's going to happen.

And you have no problem with several players taking turns on one girl. Amazing. That says a lot about you and the school you support.

So why weren't they arrested and prosecuted? There was video evidence.

The university smeared their names in the newspaper

Sooooooo...... J Brock or Solomon didnt commit and I have not even seen a JBrock photo on campus. Me thinks the boat is developing some massive holes. I dont want to make light of the lawsuit but they are going to get their day in court no matter.

How do I know this? Well, knowing the dad of one of the other cheerleaders on the team offers many insights.

This was not her for train. She has quite the reputation.

4 were accused and were innocent. I'd ask you to explain, but it won't happen.

As for a train, hell yes, I'm totally against that and think it's nuts. You pro-choicers though have to be totally for it being ok.

She was drunk and let the train begin. She could have walked out of the room at any time, gentleman. Again, it was not her first train.

I’ll comment. Are they suing the media who put their names and faces in the paper. The school suspended them during the investigation then reinstated them. If it was your daughter you’d want the same thing.

Well Brock is still on campus and we just picked up 4 commitments this AM. Guessing this not a real issue in recruits minds.

Are you really this big of an imbecile in real life? You have no idea whatsoever what happened. Yet you spout off like an idiot acting like you do, and then when people point out there are easily two sides to this you hilariously claim that they don't know what happened. Wow.

The police investigated, watched video of the incident and dropped the charges. I'm sure they are just part of an enormous patriarchal conspiracy too.

No I don't KNOW what happened anymore then someone saying that she was OK with what happened. Regardless of what the police found, (and I would imagine its more a case of what they could prove being her word against their's), you really don't see a problem with numerous guys "getting in line" to get there's. Great, enjoy........

As I said, I'm not arguing the legal aspect. If the players and former players think they have a case for defamation and damages, go for it.

But if it was my son who was participating in this behavior (even if legal) I would a) try to pull his ass out of school so fast as to make your head spin and b) be extremely disappointed. If we are at the place as a society where our 18-22 year olds think it's perfectly fine to be the 4th or 6th or 7th or whatever guy to have sex with the same girl in the same night, it's over. I realize most everyone will call me a prude or whatever, that's fine. I don't really give a damn if the girl was "okay with it." At some point someone involved in the whole mess has to say what's going on isn't right.

Do you really think anyone here believes you? Or do you think we will believe what came from the Title IX investigation? I will give you one guess on who/what we all believe.

Once again the university took aim at and labled these young men as rapists based on an accusation. They did so little investigation into the matter before doing this that four of the men they labled weren't even in the building. The others apparantly engaged in consensual sex. The young woman that also engaged in this consensual sex was not punished in any way.

For the poster that said that the police didn't declare the men innocent they just didn't think they could prove rape? The men are innocent until it is proven. That is the law and that is the way it should be in all criminal matters.

This type of behavior towards men is not acceptable.
