I think his lawyers discovered it, and realized that he had not properly produced the evidence in "discovery"; being ethical lawyers, they passed that required discoverable evidence to the opposing side and intentionally did not label it as "privileged".
Best part is looking at this picture, and most people are thinking he looks shell shocked and wide eyed about being caught committing perjury. However, I am thinking that this is the look of a guy with an awful amount of illegal crap he has texted on that phone these last two years.
