It is a detail, but an important one: Trump never submitted Berman's name to the Senate, so he is not exactly a Trump nominee. Nor was he ever confirmed by the Senate.
By the standards of HROT and most leftists out there, this makes the statement that he was a Trump nominee a total lie ... and those making that comment unmitigated and unrepentant liars.

From the New York Times sometime in the last half hour or so:
Berman was initially appointed on an interim basis by then-Attorney General Jeff Sessions for a 120-day term. At the time, some Democrats promised to use procedural efforts to block Berman's nomination.
When the end of that term came without the White House putting forth a nominee, the judges of the federal district court in Manhattan voted to appoint Berman to remain in the job. As a result, under federal law, he can serve until the Senate confirms a Trump nominee.
