President Joe Biden said Tuesday that the "basic fairness and the stability of our law demand" that the U.S. Supreme Court not overturn the landmark 1973 Roe v. Wade case that legalized abortion nationwide and said he would work to codify the right to abortion into federal law.
In a statement released a day after Politico released a draft opinion that suggested that the high court could be poised to overturn the ruling, Biden said he couldn't speak to the authenticity of the draft and said his administration is preparing for all eventualities for when the court ultimate rules.

Biden said a decision overturning Roe would raise the stakes for voters in November's heated midterm elections.

"If the Court does overturn Roe, it will fall on our nation's elected officials at all levels of government to protect a woman's right to choose," Biden said. "And it will fall on voters to elect pro-choice officials this November. At the federal level, we will need more pro-choice Senators and a pro-choice majority in the House to adopt legislation that codifies Roe, which I will work to pass and sign into law."

I'm just going to throw this out there. If this is a short term play by the dems to try to galvanize a political party destroying itself from the inside, they are blowing the load to early.

Biden is getting ahead of himself. A prudent POTUS would wait for the decision.

The Congressional Dems should lock in a lot of important gains.

Just ask yourself what the next GOP President could dismantle by Executive Order and protect those things. Look at Trump's EOs if you need any hints.

Heck, ask yourself what things a Red Congress will try to overturn starting in January. Why make Biden have to issue veto after veto?

As an example, I would start with a simple law saying all National Parks and public lands can be added to but not reduced by Executive Order.

Ditto for a law on fuel mileage. Raise CAFE by EO but not delay or reduce those standards.

Ditto on safety standards for chemicals in the environment.

And so on.

You might even be able to get Manchin on board with those. They don't cut his coal profits.

Of course that means ditching the filibuster, which Manchin says he opposes. But it's time to do whatever it takes. No one person should be able to be that destructive.
