Conservative institute sues state auditor

OPEN RECORDS LAWSUIT: A conservative public interest law firm filed a lawsuit over an open records request with the office of Democratic state auditor Rob Sand. The Kirkwood Institute’s lawsuit alleges Sand’s office is illegally withholding the release of some public records sought by the firm in an open records request. Kirkwood requested emails between Sand’s office and liberal political blogger Laura Belin and Associated Press reporter Ryan Foley. According to Kirkwood, the auditor’s office produced some requested emails but said others were withheld because they jeopardize an ongoing investigation or endanger a person’s safety.

Kirkwood Institute’s president and chief counsel Alan Ostergren alleged in a news release that Sand “has something to hide.” Sand, according to his office’s spokeswoman, said Ostergren “wrote a baseless legal attack about me prior to the 2018 election,” which was used in campaign advertising.

This feels a lot like karma. Interesting that out auditor isn't being transparent and following the law. Sorry Rob but someone writing something you don't like isn't a valid reason to withhold records. Your emails are subject to FOIA. What investigation could those two reporters be a part of that would make their communication with you not subject to open records laws? Such irony that emails with reporters would have a claim of privacy.....
 
I’m not a big fan of withholding information from FOIA requests. If there truly is an ongoing investigation, they should be released immediately upon completion of that investigation.
in the first place, FOIA only applies to Federal records. I don't think Sands is federal. Second, in many, if not most, cases FOIA requests are bullshit and come from whack jobs. Sounds like this may be one of those. Of course for many here, if a right wing whack job wants something their peepees must be sucked.

Yeah, Rob isn’t federal…I just group the FOIA term with any state open records laws because it’s the same concept and easily understood what I’m talking about. As far as who or how it’s used, I agree it’s sometimes used by whack jobs. That said, it’s the price that’s paid for transparency of our public servants in govt. that we elect and pay for. It’s worth it IMHO.
