CR drug dealer gets 5 years for illegally purchasing 31 guns to resell

A Cedar Rapids man, who as a drug user illegally purchased 31 firearms, at least 24 for other people, was sentenced last week to five years in federal prison.

Chevelle M. Daudinot Jr., 27, was convicted in December of one count of possession of a firearm by an unlawful user of a controlled substance. According to a plea agreement, he purchased 31 handguns between August 2020 and April 2021. Daudinot also falsely stated on paperwork for the gun purchase that he wasn’t an unlawful drug user.

On the paperwork for 24 of the guns, Daudinot falsely stated they were for him when he was actually buying them for other people, according to court documents.

During a search by law enforcement last May, Daudinot had only three of the firearms in his possession, according to the plea agreement. They also found over a thousand rounds of ammunition and 8 grams of marijuana.

Daudinot also consented to a search of his cellphone, which contained text messages regarding his weapons dealing, including messages soliciting and negotiating prices for firearms, along with some setting up meetings to exchange firearms.

Other text messages showed that Daudinot not only used marijuana but also was distributing it, according to court documents.

Prosecutors said four guns that Daudinot purchased were recovered during other criminal investigations. In April 2021, Chicago police recovered one from a car occupied by a felon and a minor. Through ballistics testing, the firearm was linked to a homicide that occurred in Chicago in March 2021 in which a victim died of three gunshot wounds. Daudinot told investigators he bought the guns for others to make money. He usually charged an additional $200 for each weapon, according to the plea agreement.

U.S. District Judge C.J. Williams sentenced Daudinot to five years in prison. He also was ordered to serve three years of supervised release following his prison term.
 
He should have run off to the wilderness and hid behind his wife and children, some people would have considered him a hero.

Yeah 5 years is way too light imo. Is it treated the same as if he bought a bunch of baseball cards with intent to resell as an unauthorized dealer or something?

That should be fixed.
 
I'm glad the existing laws were enforced, even if the punishment ended up being light. As a convicted felon, there's now another law that keeps the guy from buying and owning guns, plus he'll be rejected by background checks.

You serious? The guy is supplying guns to people who can’t or don’t want to have a record of purchasing them.
 
Anonymity. No checks or anything. Just buy the gun. Like what happened here.
Gun shows sell tables or booths. Some are for firearms, and others are for knives, apparel, etc. Gun dealers (FFL) still have to do background checks. ATF regulations are fuzzy on who is a dealer, but it's currently around 5 sales in a year. If someone can prove all their sales are from an existing private collection, they might get a pass.

The often misunderstood "gunshow loophole" is because guys will hang around outside the main show area, and sell a gun or guns out of their trunk. Those aren't dealers doing that. And even that is illegal if the seller has any reason to believe the buyer is disqualified from buying a firearm.

At the ones I've gone to they're not just outside they're walking around inside the gun show with signs advertising what they've got, like this guy:

And it's easy not to know the potential buyer is potentially up to no good - "don't ask, don't tell". Unless the buyer just flagrantly offers up that they're going straight to rob a bank or shoot up their office.
 
If you buy a gun from a vendor you do, but I think in most places you can do person-to-person sales/purchases at gun shows without any required paperwork.
Right. But to tie together my previous post, if an individual sells 5 guns in a year, ATF considers him/her a dealer. That seller would be required to do a background check, and would also be acting as an unlicensed dealer, which is a crime.

One off, person to person gun sales still don't require a background check.

That guy with the sign is breaking the law.

Potential buyers should be wary of that, because it could be a sting.

I didn't know that was breaking the law. I've seen people do it, but never approached anyone to find out more or to buy anything from them.

Have a BIL who sets up at shows and does no paperwork but exceeds the volume required.

He flys under the radar by not selling Black rifles nor having Stacks of boxed new guns for sale.
 
I wish we would have laws and regulations that were similar to Switzerland. I think we would have a lot less problems like this is we did.
