I believe that’s standard language for any statute related to hate crimes. If it’s a crime that is motivated based on national origin, sexual orientation, race, gender, disability, etc., then it can be considered as evidence of prejudice.

It would be interesting to see if anything outside of regular vandalism and traffic violations would stick. You’re allowed under the constitution to burn an American flag. This would raise some questions about whether or not a Pride flag receives more protections than the US flag does. Either way, dude is an epic POS bigot.

DELRAY BEACH — The State Attorney’s Office will review the case of a man accused of burning two 15-foot-long skid marks into the new LGBTQ Pride intersection and crosswalk in Delray Beach to determine whether he will face an enhanced charge of a hate crime.

The enhanced charge could be prosecuted as a second- or third-degree felony.

“It’s policy in the office to use the hate crime enhancement statute if it’s applicable,” said Mike Edmondson, spokesman for the State Attorney's Office. “It’s done when we have the supporting evidence to actually apply it.”

In its review, the agency will also examine whether Florida’s new Combating Public Disorder law fits the case.

“If it does, then it would be charged. If it doesn't, obviously it wouldn't,” Edmondson said. “It is a new statute, and we'll have to look at the effective date and some of the language in that statute, but that will be part of the intake process.”

2nd degree felony. Wow. I’ll bet he will be real pissed to get charged with that and find out that people who pull down statues don’t get charged with shit.

Yeah…but would burning someone else’s rainbow flag carry more punishment than their American flag? That’s what is at play here. If that was a US flag painted and an anti-American idiot did the same thing, what charges would there be (if any)? And interesting from a law perspective. To me anyway.
