When do they issue the first marriage license and how much will they charge?
To whom does the check get written to for the license fee? The IRS? The treasury?
They could get around TX being tough, by issuing the license. They could go right over the heads of TX and issue the license, if they think it's a "right". Go for it, feds.

Was your drivers license issued by the feds?
no and it is illegal as heck, we have the right to free travel

the drivers' license is a bigtime pet peave with true libertarians, as is the licenses the feds and states issue to work

this brings up another point: what is stopping gheys from just declaring they are common law married? then they don't need a stinking preacher or feds or state or county

straights been doing it for years

what's stopping gheys from declaring they are common law married??

One example might be many states would not honor the income tax form (joint) under such a circumstance. The Feds wouldn't either.
However, I think you need to read Justice Kennedy's majority opinion.

"What Is a Common Law Marriage? A valid common law marriage in Texas is where a man and woman become husband and wife without getting a marriage license and having a marriage ceremony. Once established, a common law marriage has the same legal effect as a ceremonial marriage. To have a common law marriage in the state, you must do three things: (1) Agree to be married (2) Live together as husband and wife, and (3) Told others (hold yourselves out) that you are married. In What Ways Do People “Hold Themselves Out” as Married? Simply put, by telling others that they are married. Examples of telling other people you are married include: • Introducing yourselves as a married couple; or • Doing something that made people think you were married, like signing credit applications as a married couple. Even if you said that you were married only one time, you can meet this requirement." - See more at: http://statelaws.findlaw.com/texas-law/common-law-marriage-in-texas.html#sthash.mWYqNQgw.dpuf

I am guessing the state shall now have to remove the one man and one woman deal, from the above, or husband and wife

Currently, churches are merely agents of the state who
are empowered to marry a couple already licensed by
the state. The church, currently, is not forced to marry
anyone. They can refuse to marry a man and a woman
or two women or two men. The Justice of the Peace
could become busy in some counties.

for now, wait till the feds send in the national guard

"Information
Being married gives people certain legal rights. Many of these legal rights don't become important until the couple splits up. If there is a marriage, whether it is a "regular" marriage or a common law marriage, when the couple splits up they can get a divorce. In a divorce, the court can decide who is responsible for paying debts, divide real estate and other property, and in limited situations, award alimony.

If we live together for seven years, don't we have a common law marriage? Maybe. There are three requirements for a couple to be married by common law in Iowa:

  1. There must be an agreement that the people are married.
  2. The couple must live together continuously as spouses.
  3. The couple needs to present themselves publically as a married couple.
There is no specific time that the couple must live together to meet the second requirement. The couple does need to live together continuously, and not just occasionally or on weekends. They also need to live together as a couple, which generally means they need to have a sexual relationship.
Both people must meet all three requirements. For example, if one person considers himself or herself married, but the other person doesn't, there is no common law marriage. "

^^^^^wow, check out iowa: got rid of the man and woman deal. just a "couple" can be common law married, no time limit

They probably could now. Until yesterday that wasn't legal in Texas. Aren't you happy the Feds expanded rights down there for you? Freedom!

"The church" is not "empowered" by anybody to marry anyone. You need a bride, a groom and two witnesses to execute a marriage license certificate. And now you cannot exclude gay people, so you now can have two brides or two grooms, whatever you want to call them.

"The church" was NEVER an 'agent of the state' in this matter. That is all in your head.

Why do you type "gheys" instead of "gays?" Is that hip slang, or is it some sort of inane insult? I honestly don't know.
