It’s very simple if you’re going to do something stupid. Don’t do something that can be easily proven as a hate crime. Wreck their flower bed. Then u can claim random drunk stupidity.

It hits differently if it’s against a protected class. There is a recent history of gay individuals being targeted simply because they are gay. How many Trump voters had their bars or hang out places burned to the ground. How many Trump voters have been singled out and beaten to death. This is why the punishment here was more severe.

"Why would it raise a question? The bias laws are similar across numerous states. In my opinion, a political sign would not fall under any bias law. However, if someone stole or tore down an American flag, it is definitely possible.

In Virginia, the law reads:
Any person violating the provisions of this section is guilty of a Class 1 misdemeanor. However, if a person intentionally selects the property entered because of the race, religious conviction, color, gender, disability, gender identity, sexual orientation, or national origin of the owner, user, or occupant of the property, the person is guilty of a Class 6 felony, and the penalty upon conviction shall include a term of confinement of at least six months.

If they have no history of making derogatory comments towards that group of people it could easily be explained as a one-time thing probably caused by alcohol and bad judgement. Common sense dictates just fine them and move on.

Really doesn't matter what civilians do...his military career should be over.

They did it multiple times. On different nights . Got drunk did it . Told their other guard buddies about it. Had a good laugh. Then went out and did it again.

Similar to if you attack the US Capitol or defend those that did, it’s clear that you hate America.
