Kellyanne Conway should be removed from WH for violating federal law: Office of Special Counsel

Under a normal administration this would be a huge scandal. Under Trump's, it isn't even the biggest news of the day, because her boss just said he would gladly collude with foreign nations to interfere with our election.

Just mind blowing.

That’s actually probably why he made the statements.

Yes, she is going to ride the gravy train as long as she can and then move on. For her, it is all about the money. I believe her and George concocted their good cop, bad cop relationship so that they could both benefit. If a Democrat were president, I bet she would defend them just as much as she defends Trump (for the right money, of course).
James Carville and Mary Matalin did this at a much lesser degree. It was at least a tiny bit believable. My guess is the Conways have sex in a giant pile of $100 bills. MAGA.

The White House said Tuesday that President Obama won’t discipline Housing and Urban Development Secretary Julian Castro, a possible running mate for Hillary Clinton, over his violation of a federal law that forbids campaigning on government property.

White House press secretary Josh Earnest said Mr. Castro had fessed up to his “inadvertent error.”

“To his credit, Secretary Castroacknowledged the mistake that he made,” Mr. Earnest said. “He owned up to it, and he’s taken the necessary steps to prevent it from happening again. That’s the expectation that people have when you make a mistake, particularly in a situation like this.”

The Office of Special Counsel said Monday that Mr. Castro violated the Hatch Act, which restricts partisan political activity by federal employees, when he praised Mrs. Clinton in an interview in April at his HUD office.

“In the end, the American people understand that she has a positive vision for the country that includes opportunity for everybody, and she can actually get it done,” Mr. Castro said at the time, with the HUD seal visible behind him.

The 41-year-old Cabinet secretary, a Texan and Hispanic who is considered a rising star in the Democratic Party, is said to be under consideration by Mrs. Clintonas her running mate for vice president

She’s expected to make her announcement within days, ahead of the start of the Democratic National Convention in Philadelphia on Monday. Agriculture Secretary Tom Vilsack is also among the contenders.

OSC investigators found that the format for the interview left the impression that Mr. Castro was speaking on behalf of his government agency, and not as a private citizen, when he touted Mrs. Clinton’s candidacy. They said he “impermissibly mixed his personal political views with official government agency business.”

Violations of the Hatch Act carry a fine of up to $1,000; offenders sometimes receive a reprimand instead.

The OSC wrote that her “violations, if left unpunished, would send a message to all federal employees that they need not abide by the Hatch Act’s restrictions. Her actions thus erode the principal foundation of our democratic system — the rule of law.”

This isn't the first time a White House or cabinet official violated the Hatch Act. It happened several times in the Obama administration but the OSC didn't recommend the removal of the official.

In 2012, the OSC said Health and Human Services Secretary Kathleen Sebelius made “extemporaneous partisan remarks” in her official capacity in violation of the Hatch Act. Sebelius acknowledged her remarks were a "mistake" and she was not removed from her position due to the violation.

Former Housing and Urban Development Secretary Julian Castro, who is now a 2020 Democratic presidential candidate, violated the Hatch Act in 2016 by praising then-Democratic presidential candidate Hillary Clinton in an interview at his HUD office, but President Obama did not remove him from his position.

“To his credit, Secretary Castro acknowledged the mistake that he made,” White House Press Secretary Josh Earnest said. “He owned up to it, and he’s taken the necessary steps to prevent it from happening again. That’s the expectation that people have when you make a mistake, particularly in a situation like this.”

The OSC was also investigating Obama's former Labor Secretary Hilda Solis for violating the Hatch Act but the matter was closed when she resigned from her positionin 2013.

According to the complaint, Solis "left a voicemail message on a subordinate employee's government-issued Blackberry in which you asked the employee to contribute toward and assist with organizing others to attend a fundraiser for the President's reelection campaign." The OSC indicated that it could re-open the probe into Solis if she were nominated for an executive branch position sometime in the future.

Please show the instance where Conway "acknowledged the mistake that he (she) made,” “He (She) owned up to it, and he’s (she's) taken the necessary steps to prevent it from happening again."
 
I guess the big difference I can see between Castro and Kellyanne is that special counsel didn't call for Castro's termination. In fact Counsel didn't call for any specific punishment at all. Counsel called for officials to be reminded of the rules so as not encourage to more violations and since Castro acknowledged the mistake and apologized it appears that Counsel's wishes were fulfilled.

Not only did Special Counsel specifically call for Kellyanne's removal, but she refused to admit that there was any mistake at all. That is a huge difference.

Whereas, Special Counsel specifically calls for Kellyanne's removal. That is a big difference. It looks clear that while both Castro violated the Hatch Act, Kellyanne's violation was so severe as to recommend termination. Castro's appears far less severe.
So severe and repeated after warnings. Callous indifference. Sound familiar?

Here is the statement Castro was in violation for:

“Now taking off my HUD hat for a second and just speaking individually, it is very clear that Hillary Clinton is the most experienced, thoughtful and prepared candidate for president we have this year,”


For this statement, Castro immediately apologized, said he was in error, and said he would fix it.

Contrast that with Conway. After her clear violation she refuses to admit any fault an claims she made no mistakes.

Clearly Conway thinks she is above the Hatch Act and thinks that she doesn't have to follow it.

Your last statement is absolutely incorrect. Kellyanne was warned by Special Counsel numerous times that she was in violation of the Hatch Act. Her response was defiant. She literally said that she wouldn't stop and that Hatch wouldn't silence her.

That leaves us two options. You either spouted off without knowing what you were talking about or your a political hack that will say whatever to defend this adminstration.

I didn't revisit the thread until this morning. I guess it would be option one. Part of what I said appears to be wrong. I hadn't realized she was covered under the Hatch Act, and I assumed that if she knew what she was doing was illegal, she wouldn't do it. Incorrect assumption, apparently.

At any rate, since it's already demonstrated that you were aware of the Hatch Act could you explain why you thought Conway wouldn't be covered given that it applies to all but a very few top-level executive positions? It would seem that the default position would be that it would apply to all executive office employees. Especially given the response you posted in November 2017 that was referenced earlier:

The Hatch Act exempts Presidential Advisors from what I can tell. Is she not considered a Presidential Advisor?

The exception is available to employees who hold positions with responsibilities that “continue outside normal duty hours and while away from the normal duty post,” such as presidential advisers or cabinet officers appointed by the President with the advice and consent of the Senate. In other words, these officials may engage in political activities during what would be considered official working time, as long as federal funds are not used for such activities. Any such official must reimburse the U.S. Treasury for the federal resources used in campaign activities.

The article in the OP’s link specifically states that the POTUS and VP are exempt, but others are not. That’s not true. It sounds like they were made during interviews and in her twitter account. Is her Twitter account an official business account or her personal? What were the tv interviews?
