Looks like Biden Administration will be forced to do their job regarding illegal immigration.

A ruling could put more pressure on the federal government to adopt a tougher removal policy for a broader range of illegal immigrants, including those that may not have committed a crime and have been in the U-S for years.

Chief Justice John Roberts noted federal immigration law mandates DHS "shall" detain and remove most non-citizens in the country illegally.

The 6-3 conservative majority seemed poised to give the states the right to sue and sharply questioned the federal government's discretionary enforcement arguments.

This type of thinking would be very helpful in letting a fascist type president put his thumb on the citizens of this country. In other words "I had no choice" as an excuse to impose draconian actions under the guise of not having any discretion.
 
I'm looking forward to the Republicans working with Joe to come up with a solution to the border...it's about time because it has been a problem for decades. I'm sure Republican leaders have wonderful solutions to so many of our issues.
But seriously-I wish one party or the other would finally do something about the 11 million illegals living in the US. Some combination of citizenship and deportation depending on the individual should work.

My solution would be if u hold a job consistently or are married to someone who is u stay. If you're a minor be in good standing at school.

It's not just the conservatives. Jackson was very pointed in her questioning of the DoJ lawyer. It's refreshing to see a Justice put aside feelings in favor of the rule of law.

There's actual amnesty, and there's functional amnesty. In the end, there's very little difference when existing laws aren't being enforced.
Existing laws are unenforceable from a pragmatic point of view. If u think inflation is bad now. Take all the illegals out of food processing. Or service industries. The supply chain. Construction, etc. It would be crazy. Every sector would have a major slow down. Not to mention going after the employers that hire them knowingly.

That may or may not be true. You are playing a shell game with the fiscal benefits by ignoring the costs.

Take 10000000 workers out of sectors doing jobs few want. From an economy already having troubles filling jobs. The system would go into shock. The benefits would not outweigh them right away. The benefits even though I think are less than the rewards of having those workers here. Would take time to acclimate enough to offset that fiscal shock.
 
We want to live by the rule of law. Congress could have used the word "may" when talking about detention. That would offer a level of discretion. They used the word "shall".
True, but by the very action of showing discretion an admin is doing the shall part of immigration enforcement. Especially if the admin is not taking resources away from enforcement. They are doing an action towards policy. If an admin was totally ignoring or defunding enforcement then they would not be doing the shall part.

I agree the immigration issue is FUBAR and needs fixed, but this has ramifications for all government discretion. Take the IRS for example. Do we want the IRS to have to sanction the guy or business down the street over a $1000 mistake or an intentional avoidance? Sure its the law but does it make sense to allocate resources that way?
 
Over a year and a half ago, Joe tasked Kamala with 'stemming the migration' on the southern border. Perhaps she is preparing to provide an update on her efforts. This was from NBC News in March of 2021.

WASHINGTON — President Joe Biden announced Wednesday that he has appointed Vice President Kamala Harris to lead efforts to stem migration across the U.S.-Mexico border, as the administration faces growing political pressure to address a surge in undocumented migrant children unaccompanied by parents.

Biden said during an immigration meeting at the White House that he had asked Harris to lead the administration's efforts with Mexico and the Northern Triangle — El Salvador, Guatemala and Honduras, countries that will "need help stemming the movement of so many folks, stemming the migration to our southern border."


A senior administration official said Harris' role would focus on "two tracks": both curbing the current flow of migrants and implementing a long-term strategy that addresses the root causes of migration. Cabinet members, including the secretary of state, are expected to work closely with Harris on these issues.

Harris said she planned to work with a number of stakeholders including the private sector, civil society and members of Congress who share the administration's interest in addressing the root causes of migration.

Someday immigration and border security will be just like overturning Roe. The Republicans will catch that car one day, and have no idea what to do with it. From 2017 through 2018 the GOP had Congress and the WH and did nothing of substance on immigration and the border.

We also know that automation and other technology is very quickly replacing unskilled workers. For example, in Florida, shingled roofs are being replaced by metal roofs. Metal roofs are way, way less labor intensive, and are cost effective when combined with insurance savings.

Really, we need to provide a deterrent to new illegal immigration. Instead, we've provided an incentive by not enforcing existing laws. That's undeniable.

The ultimate deterrent is no jobs. Hammer the employers of illegals. Best way to get corporations and businesses to change behaviors the expense has to outweigh the rewards. Current fines are just another line on the budget. They have no moral obligation to do the right thing.

Agree with hammering employers. That said, illegals working in construction and agriculture are off the books, so to speak. It's easy to go into a slaughterhouse and ask for green cards and payroll records. It's not so easy to do that at a home construction site, or tomato field.

Traditional migrate workers. Need a system were compliance has more benefits for employee and employer alike. Especially since those jobs are so ripe for scum bag human traffickers.

Thought Hispanics were trending Republican. Things change over time. The only constants seems to be old people and White God fearing folks vote Republican. Pagans, Elites, and Black folks vote Democrat.

Allow to say this for the one millionth time. No immigration reform would be worth the paper it was printed on, if we don't secure the border first.

For those anti 2nd Amendment types, it would be like making guns illegal but not closing any gun stores and not arresting anyone for having, selling or using a gun.

A significant portion of illegal immigrants came here legally. They overstayed a visa or left school. Something like that. Border enforcement doesn’t fox that.

Your post also does not address the dreamer issue. In those cases the United States is basically the only country they have known. They were brought here as children. Why is amnesty not appropriate for them?

BS. They even had Mexico assisting with keeping the illegals from border. You can't just say something and make it true. I have a very close friend who is a border agent, and he says it's never been so bad as it is now. He also says that Trump was moving them in the right direction on making their jobs much easier. I'll trust him over anything you have to say.

What have the Democrats done in the past 2 years that is of substance in regards to immigration and the border? They have Congress and the WH.

When we start to pick and choose when and how to enforce the laws on our books the entire system is thrown into chaos and people lose trust in their government,... We need to enforce all of our laws as written, and if problems are encountered laws can and should be changed.

How about we fix one issue first, closing the border. All other issues can be identified and negotiated after that. Enough of the ya-buts and what-abouts.

Except there is no tomorrow for these people if the Supreme Court rules as expected. They will be deported from the only country they’ve ever known. Who says we have to do the border first? Is that written somewhere

Obvious things don't have to be written,... When you have a plumbing leak the first thing you do is shut off the water..
