O Face Bar owner back in jail after failing to register as sex offender

A local bar owner once featured on “Bar Rescue” who served 90 days in jail after he pleaded guilty to assault with intent to commit sexual abuse is back in handcuffs after failing to register as a sex offender, among other charges.

Matthew Overmyer, 35, co-owner of the O Face Bar in Council Bluffs, was arrested Monday for not reporting to the Residential Treatment Center after getting out of jail April 4. Overmyer is also charged with escaping custody, as it was not known where he was during the 13 days between jail and his arrest, according to the police report.

Overmyer was ordered to register his address at the RTC within five days of being released from jail. According to the Pottawattamie County Sheriff’s Office, which oversees the sex offender registry for the county, he had not registered any addresses.

Overmyer appeared in court through television from the Pottawattamie County Jail Tuesday morning. He was appointed a public defender and is being held without bond for violating his probation.

On Feb. 4, 2016, Overmyer was arrested and initially pleaded not guilty to second-degree sexual abuse and assault with intent to commit sexual abuse. He later pleaded guilty to lesser charges in January.

According to court documents, Overmyer attacked a woman using physical force and strangulation to have sex with her twice on Feb. 2, 2016. He admitted in court to assaulting the victim to commit sex against her will.

Overmyer, whose bar was twice featured on Spike TV’s “Bar Rescue,” held status in the community as a business owner, according to Pottawattamie County Attorney Shelly Sudmann at his sentencing hearing.

The episode caused the Council Bluffs City Council to deny Overmyer’s bar its liquor license, a decision that was overturned on appeal to the state.


Overmyer was sentenced to two years in jail for each charge, but the time was suspended, so long as he abides by the terms of the plea agreement. He was ordered to 90 days in jail which began Jan. 16 and two years probation. He was also ordered to undergo a sex offender treatment program and have no contact with the victim for five years, plus 20 years special parole following his jail sentence.

Overmyer must register as a sex offender wherever he lives for the rest of his life. In March, a judge lowered the amount of restitution Overmyer owed to the victim to $4,600.

Overmyer’s next court date is set for April 28.

That sounds like rape to me...How can he get a 90 day sentence for assaulting a woman and choking her and forcing her to have sex?? They should lock him up for 20+
