Supreme Court says it cannot determine who leaked draft Dobbs opinion

The leak of the ruling has to be viewed by whom it benefits and who it hurts.

Did it benefit the Conservatives on the court? Absolutely not. It turned into a huge security nightmare.

Would it hurt the democrats? No. Would it help the democrats. Absolutely. It created enough chaos that it could potentially sway a justice to switch their position.
Ah yes, that natural impetus to look weak and kowtow to public opinion.
 
80 employees of the Court received digital copies of the draft prior to the leak. 34 of them admitted to printing out physical copies of the draft. Many of them told their spouses about the draft.

The leak could have been any one of those people or even multiple people. Anyone who is convinced it was a conservative or is convinced it was a liberal is simply looking through a filtered lens.
 
Regardless of the leak, Dobbs is going to be the gift that keeps on giving to the left, until it's overturned.
It won't be "overturned"

It will end up "codified" as a right. Which the same Court will then upend as "unconstitutional", based on some random religious nonsense.

As a nation it is illegal now. There is no right to it at a federal level and legislation won't likely change that.
 
Sure. Always smart to leak a 6-3 leaning decision when your hope is to find a way to negotiate and split the proverbial baby to preserve some of Roe.

Maybe you're not looking to negotiate,.. maybe you're looking to burn the house down.

If it could have been any of the 84 people, mathematically it was twice as likely to be a conservative.

Who would you have given the investigation to?
Not the marshal for a start. She reports to the SCOTUS, and is their employee.
If Roberts really wanted to get to the bottom of it he could have asked for help from DoJ, or hired outside investigators. There are people who do this stuff for corporations and other entities with security breaches. Ex Feds who have carried high level security clearances and can be paid to be discreet could have been hired. He could have empowered them to put everyone under the microscope.
It has been reported that some former clerks who had access to the Dobbs draft were not interviewed because they no longer work at the SCOTUS. That seems like an opportunity lost.
 
Clearly it was a conservative to take the wind out of the sails of the actual upcoming ruling. It was gonna happen 100% this was their attempt to limit unrest.
