Texas cuts off Medicaid funding to Planned Parenthood

Texas announced Monday that it was cutting off Medicaid funding to Planned Parenthood clinics following undercover videos featuring discussions about fetal tissue, potentially triggering a federal court fight like one unfolding in neighboring Louisiana.

Planned Parenthood affiliates statewide were told in a letter they were being cut off because they were potentially "liable, directly or by affiliation, for a series of serious Medicaid program violations" highlighted in the videos. The five-page letter from state health officials said the organization was "no longer capable of performing medical services in a professionally competent, safe, legal, and ethical manner."

Planned Parenthood blasted the move in a statement, vowing to "fight back against this outrageous, malicious, political attack in Texas with everything we've got" in order to protect women's access to health care.

Gov. Greg Abbott ordered state health officials to investigate after the secretly filmed videos were released by the anti-abortion group Center for Medical Progress, which alleges the footage showed that Planned Parenthood illegally sold fetal tissue for profit. Planned Parenthood denied the allegation and called the videos fraudulent.

Louisiana Gov. Bobby Jindal, a Republican presidential candidate, ordered his state to block funding in the wake of the videos, but Planned Parenthood filed a lawsuit arguing that Louisiana couldn't end funding for non-abortion services, such as cancer screenings and gynecological exams. On Monday, a federal judge ordered the state to continue providing Medicaid funding to Planned Parenthood clinics for 14 more days.

A similar fight may be upcoming in Texas, where thousands of women seek care through Medicaid at Planned Parenthood clinics.


"It is completely outrageous that Texas officials are using these thoroughly discredited, fraudulent videos to cut women off from preventive health care, including cancer screenings, HIV testing, and birth control," Dawn Laguens, executive vice president of Planned Parenthood Federation of America, said in a written statement Monday.

"In every state where this fraudulent smear campaign has been invoked, Planned Parenthood has fought for our patients to continue getting the high-quality, compassionate health care we provide, and in every state we've won."

Laguenst stopped short of announcing a counter lawsuit, but noted that federal courts have consistently found that federal law prohibits states from booting abortion providers from Medicaid, including in Indiana and Arizona.

The letter sent to Texas clinics attempts to address the issue of access to other health services. The letter, sent by the Texas Health and Human Services Commission's Office of Inspector General, said termination from the Medicaid program won't affect women's access to health care "because there are thousands of alternate providers in Texas... that participate in the Texas Women's Health Program and Medicaid."

The letter noted that since 2013, the GOP-controlled Texas Legislature has moved to deny as much funding as possible to Planned Parenthood, including shutting the group out of the Texas Women's Health Program, which provides care to poor residents.

The Medicaid violations alleged in the letter include indications from the videos that its affiliates "follow a policy of agreeing to procure fetal tissue even if it means altering the timing or method of an abortion." The state also accuses the organization of failing to prevent conditions that would allow the spread of infectious diseases, and not training staff in infection control when handling fetal blood or tissue.

On Monday, Abbott said his state "has stepped forward and shown its unyielding commitment to both protecting life and providing women's health services."

"The gruesome harvesting of baby body parts by Planned Parenthood will not be allowed in Texas and the barbaric practice must be brought to an end," Abbott said in a statement. "Ending the Medicaid participation of Planned Parenthood affiliates in the State of Texas is another step in providing greater access to safe health care for women while protecting our most vulnerable — the unborn."

How do you compare not wanting to fund planned parenthood with Sharia Law?

Read the definition of "sharia law" sometime Nole and get back to me. It provides a "legal framework" inwhich private areas of life can be regulated via Muslim law......this "Texas law" is just the Texas version of "sharia law." And I bet it does not reflect the majority of Texans and how they feel towards PP.

You do understand that MedicAid $$$ is money from Texas. It is $$$ sent to Texas by the Feds to provide healthcare for Texans. The State of Texas administrates the program. THe rules are set down by the Feds. That is the agreement.

Sorry...I missed the word "not"...the money is NOT from Texas, it is from the Feds. You want Texas to drop itself from the MedicAid program? That would b political suicide, even in Texas. Texas would go broke or have to institute an income tax. The $$$ MedicAid provides Texas has to be astronomical.

I believe, by law, Texas has to fund PP with a portion of its provided MedicAid funds. You are saying that Texas can get along cheaper w/o paying PP its portion of the $500M the Feds have delegated for PP nationwide, at risk of losing their MedicAid funding totally?
I don't understand at all. As I said earlier, it is NOT solving any problems....problems that have been PROVEN to be unfounded.....and it resembles "picking scabs." Move on tejas, move on. Obviously, your legislature works way too long and doesn't have much to do.

I remember reading back when the defund PP movement started that there are laws stating that any qualified provider is eligible to receive medicaid reimbursements. Basically allowing patients to go to any qualified provider that will take them. That's probably why the state is claiming that PP is "no longer capable of performing medical services in a professionally competent, safe, legal, and ethical manner." Sounds like they are going to try to make the case that PP shouldn't be considered a qualified provider.

If a state would arbitrarily refuse to distrubute monies as agreed...and Im sure PP is "guaranteed" a %, couldn't the Feds demand payment by citing their agreement for distribution of PP funds? A logical extension would be the Feds not distributing any MedicAid $$ to Texas until they complied. Could Texas afford to lose its MedicAid funds? I doubt it.

Wouldn't pulling back funding mean de-regulation? I don't think most people really know that those clinics receive a lot of government subsidizing that their own docs and hospitals don't get. In other words, I don't think most people would care less if PP existed or did not

Is this even true though? It's my understanding PP receives mostly medicaid and some Title X reimbursements. It's not like they get a block of money they can do whatever they want with.

PP is the leading abortion provider in the country. On demand abortion from conception to the birth channel is the holy grail for Dems. It must be protected at all costs They will attempt to destroy any one or any thing who gets in their way.
