Trump Organization attorneys given Monday deadline to persuade prosecutors not to file charges against it

A centrally controlled web of corrupt businesses all headed by Trump himself. Hard to think his fingerprints aren't on any if this.
Of course Trump was intimately involved in every major financial transaction and all important business decisions. Michael Cohen and other long time employees have already confirmed that virtually everything needed to be approved by Trump first.

In order to criminally charge Trump, the prosecution needs Weisselberg to cooperate and testify on behalf of the government. It appears that his is not presently cooperating. If this is true, IMO the biggest question remaining is whether the Manhattan DA will charge Weissellberg individually. I seriously doubt he would be willing to face a long prison term in order to protect Trump.

I am not a lawyer, but I don't think they need Weisselberg. It would obviously be helpful, but Trump was the CEO, and he signed the documents and checks. As has been mentioned several times, Trump Org was not a big company, and they will be able to find plenty of people who will say that all decisions flowed through Trump. The COO has already testified in front of the grand jury, and he has received immunity. I am sure there are others at Trump Org who will speak, and people at companies (Mazars), who will be able to tie Trump to specific things, or say he was at critical meetings. Oh, and they have probably a million pieces of paper now after getting all of the documents they requested.
Even if Trump refuses to sit for a deposition, or does not take the stand, the prosecutors will be able to find plenty of video or audio content where Trump speaks of how brilliant and involved he was while leading his company. It will be hard for the defense to convince a jury that Trump was a unaware of such consequential actions as major tax fraud.

The only reason I could imagine that they’ve thrown this deadline out there, is this is meant to panic. Moving money around, false documents, who knows.

But the SDNY & Tish James already know enough to bury him under Otisville Prison.

They aren't putting this out there. It seems like Trump's team is being very public.

I was referring more that they told his lawyers. I doubt it’s out of professional courtesy, given his attorneys aren’t very professional and deserve zero courtesy.

I don’t know what benefit Trump or his legal beagles would be seeking if they are leaking it. Which is ironic, now that we know what depths that worthless POS will stoop to in order to out leakers.

So the anticipated charges are failing to pay taxes on fringe benefits to executives? And the charges are levied against the organization, not individuals?

“Several lawyers who specialize in tax rules have told The New York Times that it would be highly unusual to indict a company just for failing to pay taxes on fringe benefits. None of them could cite any recent example, noting that many companies provide their employees with benefits like company cars.”

Yeah, nothing is going to come of this but the story will get a lot of clicks which I guess is the point.

LOL, wasting a brand new handle on this thread.

Looks like Trump will survive the first round of indictments at least. His lawyers say that Vance's team told them that Trump wouldn't be part of the first indictments coming out. What this means is hard to say. Maybe Trump won't be indicted at all. Or maybe, as Vance says, "The investigation is ongoing," and Trump will be later named.

Knew this wouldn’t amount to squat.
It never does.

That’s not all that irregular. They’ll likely charge old man Weisselberg and others in proximity to Trump’s circle first. You get convictions there and fatso is just a big orange target in an ill fitting suit.

And in between his kids will probably be indicted in DC.

You would think so, but Vance supposedly said that everything but taxes is off the table at this time. So what leverage would they have to force anybody to flip? It doesn't sound like what is remaining, which is not paying taxes on benefits, is something that would even lead to prison. Hate to say it, but it looks like Trump will once again skate free.

This is going to become an issue if it is not handled properly. If all they have found are executive benefits that those executives did not report the "this was always a witch hunt to steal the election" type of bs will start getting played non stop, emboldening the Trump won lunatics.

These investigations have been huge news , swinging and missing badly will give that asshat and his followers renewed hope.

And then when you do some more reading, you come across stuff like this:

"(Trump's lawyer) said prosecutors have told him Trump himself will not be charged at this time — “at least not with what’s coming down this week” — but added the investigation is continuing.

“There is no indictment coming down this week against the former president,” Fischetti said in a telephone interview Monday. “I can’t say he’s out of the woods yet completely.”

Taxes could be just about untaxed benefits, sure.

But it could also include fraud by deception for putting undervalued tax liability on every property he owns in NY for tax purposes, while inflating their values on loan documents.

Not saying it is, but ‘taxes’ is a pretty big umbrella.

"The prospective charges this week, he said, “are limited to a couple of Trump Org employees who didn’t declare taxes on fringe benefits” they received. The company itself also could be charged, he added."

Couple of things with this. If the charges being leveled this week are all we will see, Trump is golden. But if the charges this week are just the beginning of what Vance has in store, Trump could still be in serious trouble. It does strain reason to think this whole investigation was all to get just a couple of low level Trump employee who didn't declare taxes on bennies.

Like I said, nothing is going to happen. The stories will be written in a way to keep you clicking and reading though.

I caught Ari Melber on Cohen’s latest Mea Culpa podcast. And both of them point out that the state of NY just got his taxes and other documents in February. That’s a lot of documents to review in less than 5 months. But he wouldn’t be the subject of investigation if he didn’t he was doing things on the up and up.

I guess we will find out soon enough. If by next Monday, Vance says this week's charges are all they will pursue, then this will have amounted to a ridiculous level of teasing. But if we don't get such a statement, watch out, this thing is just beginning.

"Weisselberg’s attorney, Mary Mulligan, has declined to comment."

Any of you remember who was the first person indicted by Robert Mueller? Any of you remember that time frame?

Let’s say Trump himself is never charged. There are lots of problems for Trump Org from managing loans, to keeping his liquor licenses. Now, Desantis will probably pull levers for him in Florida, but how do you run a golf club in NJ with no ability to sell booze to patrons?

Here is the other challenge to consider. If the Trump Org is charged criminally, every lender can legally call his note in full, on the spot. And he’s already facing upwards of $900m balloon payments, 1/2 due in a couple of months, that he personally guaranteed,

If that happens, he’ll assuredly end up back in bankruptcy court for, what, his 8th time?

I know that his lawyer is arguing that charges will make it difficult for the organization to do business. Not that this would be any sort of persuasion, but it is still true. Also they did convene a Grand Jury over this which has yet to give their findings. It strains reason that they would do this is all they had were a few people not paying taxes on cars and apartment leases.

Jesus, Trump's lawyer is 84. Alan Dershowitz, who completely made a fool of himself with Trump and Guiliani, is younger than him.

They just seated a new, special grand jury less than 1 month ago.

You don’t do that for fishing expeditions.

A special grand jury is secretly hearing from witnesses in the Manhattan DA's Trump investigation.
