This is heartbreaking for the family of this officer. At this point one pretty much has to assume they're trying to chase police out of cities. Why would any decently capable person want to sign up for that job when the prosecutors won't even go after someone who recklessly runs you over and kills you?
 
All 16- and 17-year-olds who commit non-violent crimes will receive the intervention and evidence-based treatment they need.

This is the part of the law this prosecutor is clinging to. How they can claim that recklessly driving over a police officer is not violent is beyond me.

They are dropped. It's now up to a different court to determine next steps and possible charges. The DA absolutely could have prosecuted him.
 
Under the state's Raise the Age law, 16- and 17-year-olds charged with serious felonies automatically remain in criminal court if certain aggravating factors like the use of a weapon are involved.
But absent those, prosecutors can only keep a felony from being transfered to Family Court if they identify "extraordinary circumstances". That could include heinous behavior or prior criminal activity but is not specifically defined in the 2017 legislation.

The Yonkers police spokesman, Detective Sgt. Frank DiDomizio, emphasized that it was the court’s authority to move the case and that it was done solely on the basis of the restrictions in the raise the age laws.
