Appeals court rules in favor of gay marriage in Kentucky

Well, that's just dumb. She's not doing her job. She should be fired.
Unfortunately, you can't simply fire an elected official. There has to be an official inquiry into her actions to determine if she is not fulfilling her duties as defined within her oath of office. I could be wrong, but I think it would be this course that impeachment proceedings would take place and if found guilty by the Kentucky legislature of violating her duties then she could be removed from office.

Personally I think a functionary like the county clerk aught to just be an appointed job or something like that. Usually we elect people to make decisions on our behalf, but this job and some other jobs seem to be mostly about managing an office.

I agree with you on both parts. I don't see why that is an elected position.

So I guess she needs to be impeached?

Apparently from the articles I'm read as I'm no expert on Kentucky state law the state legislature can do it, but they arn't in secession.

Plus you never know given it's Kentucky how many people in the legislature might vote no to remove her.

It's really a case study. . . it's really really hard to remove an elected official. Its sort of like how Toronto had to put up with Rob Ford for years. Was video taped smoking crack but can't be removed.

That's my understanding as well (I alluded to that in a previous post). She could be formally charged with some misdemeanor of sorts (not executing her duties or something like that). Then that could be what's needed to bring about impeachment proceedings. If it went that far, the legislature would still have to rule on her guilt or innocence though, which may not be a slam dunk given the nature of the case.

Sheesh this really confirms my opinion that governmental functionaries like clerks need to be appointed or in some other way selected and not elected.

They don't really make decisions on our behalf they just manage an office.

The only problem though is letting mayors appoint them will result in cronyism.
 
We know gods punishment time to find out what mankind will do to her. I'd take the lame activist court punishment over what god will do

This saga has nothing to do with her pious religious beliefs; it's all about the gravy train of donations from gullible Christian conservatives who will open their checkbooks & rally to support her.

I really don't see how you can claim that, at least without going full-on blowhard. She is putting her elected position at risk, and is standing up to the federal courts...you think this is to raise money? To get the limelight? She is a measly clerk in a Tenn. county, I doubt that was that much on her mind. Sure, now that she is famous maybe it has an effect, but I think it very disrespectful and disingenuous to somehow claim she is doing it for nefarious reasons.

But, the question is what her motives are. She may profit from this.............is that why you think she started declining people for licenses? I see no reason to doubt her religious sincerity, however wrong/incorrect/misguided I think it may be.

Also, I don't think it helps to try and label her this way. This argument needs to be fought/won on the grounds of the issue, not whether she is doing it for money or not, so give her the benefit of the doubt. IF she isn't doing it for money, and is 100% sincere in her religious belief......it shouldn't change the legal argument, nor your opinion.

The latest on the county clerk in Kentucky who has refused to issue marriage licenses since the Supreme Court legalized gay marriage (all times local):
1:05 p.m.
A federal judge has ordered a defiant Kentucky clerk to jail after she refused to issue marriage licenses to gay couples.
U.S. District Judge David Bunning told Rowan County Clerk Kim Davis she would be jailed until she complied with his order to issue the licenses. Davis said "thank you" before she was led out of the courtroom by a U.S. marshal. She was not in handcuffs.
Davis has refused to issue marriages licenses for two months since the Supreme Court legalized gay marriage. She argues that her Christian faith should exempt her from signing the licenses.

I would've thought he'd issue daily fines, and order her to also forfeit any 3rd party 'donations' to help her cause. Maybe that's next.

A federal judge is warning deputy clerks in Kentucky that they must issue marriage licenses to gay couples or face fines or jail.
U.S. District Judge David Bunning already jailed Rowan County Clerk Kim Davis for refusing to comply with his order. She was led out of the courtroom by U.S. marshals on Thursday.
The judge gave the deputy clerks time to go meet with public defenders and said the hearing will resume at 1:45 p.m.

Well, I guess that above poster was correct about jailing her then moving on down the line. Deputy clerks now get lawyers, my guess is they are next should they refuse.

I don't like the jailing, but I understand it.
