Boasberg issues contempt orders

This will be an interesting fight. This judge won't be the final arbiter. John Roberts just said some bad words.

John Roberts upheld the claims that due process was improperly withheld.
I seriously doubt Boasberg's law school roomie is going to be ruling against him here, either. More than likely going to be pissed off his LS friend's authority is being ignored by the administration.

Bondi and Homan are the ones who made the call on it.
They can claim "Trump told me to do it", but that was an illegal order (against a court injunction) and is not a defense.

Would love to see Boasberg hold them in jail UNTIL the contempt is fixed (people are returned to be afforded due process).

As far as how would it? You seem like an educated person, someone who might know and understand what the USSC ruling on immunity means. See unlike the poison jabs that offer virtually no immunity now, The Court declared that a President is immune from prosecution when exercising the 'core powers' of the presidency. Immunity means a person cannot be prosecuted – it is not merely a defense to prosecution.

While the court found that a president’s actions as a private individual are not immune to criminal prosecution, it held that presidents do have substantial immunity for their official actions – even when undertaken for personal ends and criminal purposes.

Surprised to hear that coming from you. I imagine Trump will insulate himself from this. If someone is in contempt my guess is it will be Bondi’s team, maybe even Bondi herself.

I would LOVE to bring this issue back up to the Supreme Court and give them a chance to correct it. Wouldn’t surprise me to see a 5-4 decision coming down against presidential immunity.

I’m not sure the MS-13 member we sent home is the case you want for this purpose, but I don’t disagree with you… I do want to see SOME guard rails installed so Presidents don’t have blanket immunity even for official acts.

Seems like a good chance for congress to act and get something done… maybe they can propose some legislation that limits presidential immunity with something the right wants like voter ID… let’s see what really matters to the Republican Party.

If it’s a federal charge, I’m pretty sure he COULD. Perhaps he should consult President Biden, he seems to be an expert on Presidential pardons.

Whomever directed the pilot to continue on and defied the order is who Boasberg is after.

Likely Bondi, Homan or Miller. NONE of them have any SC "Presidential Immunity" clause in their roles.
If they defied the court and broke the law, they deserve whatever the court decides should be their punishment. I don’t think this is as cut and dry and some people want it to be though.

He either asserts the power of the judiciary and maintains the separation of powers or he cedes authoritarian power to the executive and for all intents and purposes our unique form of representative democracy is destroyed.

We are into throwing kidnappers in jail.

Hell, they won't even HAVE to go to jail for kidnapping (despite being guilty) if they bring him back.

Pretty good deal for criminals who act like they are above the law and have already flouted judge's orders.

So we should let people have their constitutional rights trampled and the judicial branch lose constitutionally-appointed power until we find just the right sympathetic victim?

Trump will not follow any court orders. He has immunity so why would he need to listen to anything the courts say? He’ll continue to dare them to do something.

This is where congress is gonna have to step up and come together and put up some
guard rails that more clearly define the limitations of all the branches of government but especially the Executive branch.

As flat out dumb as some of the stuff Trump tries is, this problem likely won’t get better on its own. The next president and the ones that follow will keep pushing the envelope and where that leads is no where good.
