Employee asks Employer not to throw him a birthday party...

Plaintiff deserves the cash simply for bringing Trad and Lucas into agreement here. If Trad is on the employee’s side, the guy has to have an ironclad case.

Oh, this company screwed up here over and over again. Absolutely horrible response at every step. And the cherry on top was putting this in front of a jury. That should have never ever happened.

Agreed. No idea how they didn’t settle this out. “Your honor, he made his wishes very clear at every turn, but we didn’t care and plowed ahead anyway. We should win.”

Sorry, should have taken it like a champ is what I meant to say.
Still, everything past the party is on the company. I'd excuse the party, but everything else is a cascading failure.

Why? He requested to not have one because it induces stress he can't handle. When they threw one, he removed himself from the situation that causes him stress. That should have been the end of it. What good does it do for him or anyone else to "take it like a champ." He didn't want to be there, and I'm betting none of his coworkers did either.

I’m also willing to bet that there aren’t all that many companies that throw birthday parties for their employees. It’s a waste of resources and productivity.

Instead of throwing a party, they should have offered the dude the day off. If he doesn’t want to take his birthday off, he can save it for a day of his choosing. It’s water under the bridge at that point, but the moral of the story is, parties are for kids. This is the work force, not the third grade. Nobody gives a shit about cake except for fat middle aged women.

If you need people to make a big deal about your birthday after the age of 21, you are an attention whore…..:and dont get me started on these “birthday month” people

Knowing how your employees don't want to be recognized for their work or occasions such as birthdays is very important. For some, there is nothing worse than being recognized in a group meeting for their outstanding work.
