Impeach Obama Over Background Checks?

When asked what the GOP should do if Obama issues an executive order on guns, Tom DeLay first said the House should "defund his lawless actions." When prompted, he agreed it would be an impeachable offense.

According to the article, Obama is considering an executive order that would expand some background checks.

The guns and impeachment part starts around the 4:22 mark. But the earlier discussion of Paul Ryan is interesting, too - especially the claims (1) that Ryan favors amnesty, and (2) that he is trying to exercise dictatorial powers that would, among other things, prevent his removal from the Speakership position.

Personally I support a weaker executive, and feel that the overuse of executive orders should come to an end. However, it think it is up to the Supreme Court to decide on where that line should be drawn.

I agree that the E.O. thing is out of control. Unfortunately, I don't think anything short of a Constitutional amendment will rein it in.
 
You seriously want to know the answer to the question: "why should one branch set the rules for another"?
I started to respond in detail earlier and realized my heart really isn't into sparring over this.

I certainly don't believe extending background checks to high volume gun sales where they don't currently come into play in a consistent fashion constitutes an abuse of executive authority. I'd be surprised if you did, either. But even if it did, I think the correct routes to follow would be to, first, to try to ger Congress the clarify the law. Then, failing that, the impeachment route strikes me as being a more constitutionally sound way for Congress to rein in such an "abuse" than punting to the Court.

But if you want to argue the Court route, I'll pay attention.
