Uh yeah. It doesn’t matter if it was a drunk girl coming on to you at the bar, a perfect stranger or your wife.

If they did not willingly consent then don’t do it…full stop.

Any guy that doesn’t understand that is SOTE.
I figure if you ever find yourself having to provide an explanation or justification for having sex with someone, and why it was technically not rape, it's pretty likely that you raped someone.

One way to help the Neanderthals that don’t understand this:

If the tables were turned and the woman was pegging you would you be ok with it or do you think you should have to give consent?

She still consented but is passed out.
I honestly don’t know how anyone would think this was ok but, would it be considered rape beings she consented before passing out?

The issue is that rather than use this story to point out how poorly written the law is, he used it to laugh at the women who ignored the law and claimed it was rape. He found this "bemusing." Which is a pretty vile attitude.

She has to be able to withdraw consent as well. Consent must be present through the whole act.

If she has full capacity and changes her mind mid-act, you still have to stop.

He was in New Jersey talking about Minnesota law. The law itself is immaterial. Rape is having sex with someone without their consent.

You know who leans into the law and says what they’re doing isn’t rape? The Taliban, ISIS, and the guys having sex with 9 year-olds in Iraq.
 
100% rape. But I think the op was talking about law. What state was he talking about? Is it rape by law in that state?

Military has had issues with sexual assault/rape. It’s zero tolerance now correct. Not a good look for the DOD head to have this history of pointing out technicalities and paying off sexual assault claims.

The answer is: Would a reasonable person believe she was of sound mind when she consented?

He’s saying the panel made it sound absolute. When he’s pointing out an exception. Seems to be confused about the point of the orientation as well. The point was to tell folks there is no shade of gray. He obviously lacks some social skills or unable to read the room.
 
I really don't mean to make light of the situation or be crude but it can't be that hot to have sex with a passed out woman?
