Should someone who doesn't have the right nor is allowed to do a certain thing, have the moral right to give someone else power to do that very same thing?

I.E. Should a politician/lawmaker/etc., who is not allowed to kill someone without suffering consequences of the law, have the ability to give power in the form of law, so that they may hand over the right to kill, to another person.

A.E.,...I'm not allowed to kill someone by law, but you are, because I say so.
