MSU is disgusting

I don't see how paying victims for the abuse they suffered should provide a legal reason to shut them up. Even if it is half a billion dollars.

"Ramya Krishnan, a legal fellow with the Knight First Amendment Institute at Columbia University, seems to think that in this case, the public interest in hearing the advocacy is significant. “A condition that prevents survivors from advocating for legislative reform raises serious public policy concerns,” she wrote in an email. “While the courts are generally deferential to settlement agreements, they will not enforce terms that clearly violate the public interest. Relying on the First Amendment, courts have a recognized public policy in allowing free speech on important public issues. Responding to sexual abuse is one of the most urgent issues we face. The public has a right to hear from the crucial voice of survivors in this conversation. A provision requiring survivors not to speak—even on a narrow subset of measures—would do significant damage to that interest.”

Tells you how serious they are about it - just want to sweep it under the bed. Allowing Izzo and Dantonio to keep coaching after both coaches had issues with players committing sexual assault crimes. Really staggering how this did not blow up like Penn St did. Was it because of Joe Pa’s pristine reputation? We don’t give a shit if the perp is already a known POS?

Sorry. I disagree. The survivors are not being forced to do anything. They have the ability to accept or decline the settlement. It's called making a choice which people do every day.

Sorry, I disagree. Read the article. It isn't a nondisclosure clause, but rather a promise to not participate in the political process by speaking about legislation. That is patently illegal. You can't sign away your constitutional rights!

Michigan Sex Assault University is a cesspool who has proven time and again to only care about its reputation.

The survivors were forced to get sexually assaulted and deserve whatever they want from the scum university including and not limited to: cash settlement, ability to speak freely about their story and coaches/leadership losing their job. Stop being an ass hat. Money shouldn’t be able to buy guilt or innocence

In that case, it's probably unenforceable. A contract has to be legal to be valid.

Remember when there were announcers during games talking up Dantonio, like he was some kind of role model.

Hope they feel a little slimy now.

MSU is an upstanding institution and Dantonio is a coach with an extremely high moral compass. This is true, as long as you believe what MSU will tell you.

I did not say it was a non-disclosure. I said they are not being forced to do anything. They have been given a choice. It is up to them to decide if they will accept the money with the stipulation or not. Could care less what you think of MSU as it has no impact on the choice and the decisions.

Your emotions have nothing to do with the proposed settlement, and while you are entitled to your opinion, that is not what was offered. We are dealing with the reality of an offer, not what you think, feel, or believe is justified.
Personally I believe that the doctor was a scum bag and the University was more than negligent. However, that does not change the offer made. if they don't like it they don't have to accept. Oh, and glad to see that you have such an impressive vocabulary.

Simple solution, don't take the money and keep pressing until you are satisfied with the punishment doled out.

I think hush money is one of the dirtiest "legal" ways of keeping victims silent, but the victims have the right to not take the money because it further buries their self respect. If you put a price on your silence then you made that decision. The Cosby case is a prime example of greed.

It could also be an indictment of the prosecution, many of these lawyers will happily agree to a slice of that pie on their clients behalf. If you accept money to acquit your case then you made that decision on your own.

The whole thing is just filthy.
