It is. You posted an article suggesting the court was going after aca benefits by taking up these cases, when in fact, if the court didn’t take them up, they would be eliminated by virtue of the 5circuit decision. So which do you prefer: elimination, or a chance at an appeal?

Not for manufacturers. But if you’re suggesting (out of your ass) that somehow they don’t have to make any concessions under that benefit, you’d be wrong on that front too. The typical part gross to net discount is in the 25-40% range. Without offering those concessions, manufacturers products will not be covered, or will it will be limited. Drugs don’t get on formularies by magic.
