Revenue Sharing, NIL and Title IX

I believe the talk is that the DOE will be eliminated. I don't believe an admin agency of the government will have authority over private agreements between private parties for compensation and personal services contracts. I would not expect the "guidance" to survive the next administration or legal scrutiny.

This.

There’s just no way to legally say “title IX” is enforceable in this manner.

The funds supplied are not Federal/State dollars

Far from being a lawyer here, but I was thinking if this was “revshare” money, then maybe. It does say “from a school.” Has there been movement that NIL will be distributed by schools?

I don’t expect it to survive either, but they are referring to the money that schools re-distribute from their revenues, not NIL that individual athletes earn.

Doesn't mean there won't be 1000 lawyers and some judges willing to screw shit up even worse. Hopefully the revenue goes to the guys that actually earn it. Maybe all football players should identify as female while in college.

As the law stands today, any school that receives federal funding must abide by Title IX. That’s every college and university in America. Once the schools receive the money from any outside source, it becomes their money and Title IX, as it stands today, has a say in what they do with it. Very much like distribution of scholarships.

I love how all they care about regarding Title IX is money and scholarships for sports, all the other stuff...compliance doesn't matter.

As an example Hillsdale does not

If this reporting is accurate, very likely this DOE directive (?) will be appealed, and stayed by lower court. A legal 'head scratcher', huge departure from case law. What motive (?), seems to be the question that screams-out. The NCAA appears to have some connections with the incoming administration, an 'executive action' could reset NIL legal anticeedent.

Still, with current SCOTUS, it's anyone's guess. TikTock wrestling fans!

If you think that’s all Title IX cares about you’re either ignorant or not paying attention.

Schools don’t distribute NIL. The links are convoluting NIL with profit sharing. This is really about the latter.

And when Title IX and NIL Collectives collide?

More from Mit Winter, a college athletics attorney:

The Dept of Ed also hinted it may try to apply Title IX to NIL compensation paid by NIL collectives in the same manner as it says it will apply Title IX to payments made by schools.
