In this case the state of Virginia isn't identifying anyone as being an ineligible voter,.. The individual has self identified as a non-citizen, which renders them ineligible to vote.
...and, if i'm understanding your explanation of the process right, the Commonwealth is initially/provisionally 'registering' them as eligiblel to vote notwithstanding the fact that they probably shouldn't be given the noncitizen identification.

I would imagine if i looked hard enough i could find some sort of analogy to medicare reimbursement disputes.

Prosecute any individual, including those who have not “self identified” if they cast a ballot and are, in fact, ineligible to do so.

The late purge (too late according to the DOJ) is simply a grandstanding act by Younkin.

It's clumsy no doubt, but this is their process,... Certainly not part of a wholesale sweep to toss voters off the roles.
