Wasn't clear the intent was to steal with Biden. We've had other politicians end up with the documents; all cooperated and returned except Trump.
Trump hadn't declassified the documents nor had a standing order to, hence he needed to return them like everyone else.

I don't know of anyone charged of a crime that actually returned the documents upon request.
I also don't know any of the motives behind any documents being kept by anyone.
We have decades of people keeping classified documents without charges being made, is my point. It's something you don't seem to be charged for if you return the documents.
