From what I have heard from various legal eagles on TV, the prosecutors can only ask the judge to dismiss the charges. Since the charges were already filed and in the court docket it is the judge that determines if there is insufficient evidence or poor evidence for a trial. Correct me if I incorrectly heard these former and current Fed and ST prosecutors.
The prosecutors knew that they had a very strong case so it would be unethical for them to ask the judge to drop it.
