Earlier Friday, an appeals court reversed Jose Inez Garcia-Zarate’s 2017 conviction for possession of a firearm by a felon.

This comes after he accused a judge of failing to tell the jury it’s not a crime to “momentarily” have a gun. The 46-year-old claims he found the firearm on a San Francisco pier, picked it up, and it “accidentally” went off.

The bullet then ricocheted off a concrete-walkway, before fatally striking Steinle. Garcia-Zarate then threw the gun into the bay. He was deported five times before Steinle’s death, sparking a nationwide debate over sanctuary city policies.
 
He possessed the gun long enough to kill Kate Steinle. Isn't that good enough for these moron judges?

The feds are moving in on this.

Well, what's the law? How long do you need to hold it to be in possession of it?

Will Trump's previous tweets about this and his almost certain future tweets affect a federal trial?
 
This fit's the "the gun is the criminal" narrative perfectly. Many should welcome this decision.
 
This guy has been indicted in federal court for felon in possession of a firearm and alien in possession of a firearm. I think trial is set for January. Momentary possession means nothing under federal law.

His attorney is claiming it's unpreceded to file federal charges on top of state charges. Perhaps this attorney forgot about the police that beat Rodney King.
