According to the article the One doing the indicting is the republican and he is doing it improperly. Also according to the article if anyone should be arrested, it should be those who were actually assaulting others by throwing rocks at them.

Can't see from this article, or others on the first couple pages of google or bing, anybody know what is actually alleged to be the threat(s) made? I assume it is not the "we see you" on the video that caused the party-goer to yell to "stop that truck that's a threat." Again assuming, probably something much more threatening was done/said prior to the arrival of several police cars. Too bad the media again fails miserably in reporting facts in favor of attention grabbing headlines.
Not knowing more details, sure smells like a publicity seeking prosecutor trying to achieve name-recognition through overcharging. The statute provides a MINIMUM 5 years. Pretty harsh for buffoonish ignorant behavior of racist goons who no doubt would say they are just celebrating their heritage. That having been said I've never seen too many black people flying openly racist symbols and there is no long history of systematic oppression and lynchings behind those symbols.
Black racists may say racist things, and there may be hate crimes committed by individual blacks against whites (which arn't called that for political reasons) But I've never seen a picture of a whole crowd of black people holding a party while a white guy was hanging from a noose. I've never seen black people do something horribly violent and it being completely obvious that it was them and then being found not guilty by an all black jury.
I've never seen a black state house enact laws to make sure that the white people don't go to their schools which are clearly better in every single way.
The confederate flag was there for all of this organized societal oppression and much more. Created to symbolized a rebel group that was fighting to keep African Americans enslaved. It is therefore racist based on it's very history, no matter how many people think differently. And the fact that there are black racists that exist does not in any way make it ok to be a white racist or to fly racist symbols.
You've never seen any of that in these current times either Hoosier. The past does not justify the present. The fact is, that all those things you listed, which we've had crammed down our throats since grade school, is simply history that is atrocious, but shouldn't ever be used to undermine the progress that has been made since.

No, I said the idea of charging people for flying a flag is improper. It's actually asinine. flying a flag is not a crime. throwing rocks at people is. It has nothing to do with any groups. Frankly, if I was the DA, I wouldn't charge anyone, as there doesn't appear to be any evidence other than unsubstantiated claims, however, if I'm going to arrest someone based on such claims, I will treat the claims equally, and not play favorites. I'm certainly not going to use a BS terror/gang law in a case where it clearly should not apply.
