When a company publicly comes out and says they will be discontinuing a practice, that means they've been doing the practice.

The US government has a lot of leverage to get private companies to do what they want. I linked the House Weaponization report in the post above so you can educate yourself. I don't know the exact legality of what the Biden administration did, but I assume this will be litigated over the next few years.
