Man charged with 5th drunken driving offense, four times over legal limit

ELK MOUND, Wis. (WEAU/Gray News) - A man was charged with driving while drunk for the fifth time earlier this month.

According to authorities, Mark Prieve, 56, was driving the wrong way on a highway in Elk Mound, Wisconsin. He failed to respond to police lights and sirens and continued driving in the wrong lane before pulling into a parking lot.

Prieve refused to take a field sobriety test but took a breathalyzer test with a result of .329, which is four times the legal limit.


Prieve was arrested and charged with his fifth offense of operating while intoxicated. He was also charged with fleeing an officer and driving the wrong way.

He was already on probation for a previous felony operating while intoxicated offense.
The guy who owns and operates The Treehouse pub in Bettendorf has 12.

I have no idea how that jackass isn’t in jail.


 
The idiosyncrasies of the plea system. Often people are arrested for the 4th or 5th time but they plea it down to 2nd offense. We don’t have the prison space to lock them up.

I think a pretty harsh home confinement system is the way to go. Put a monitor on them. If they leave the house for anything unapproved they spend a month in jail. If they drive anything it’s at least six months.

Philosophically shouldn’t they be charged with something like attempted murder? What’s the difference between this and firing a pistol aimlessly?

Make them pick up trash everyday along the highways they drive drunk on so they can see how dangerous it is to be on or near the very roads they decide to use while operating under the influence. I’d hope it would make them realize how very serious it is not to drink and drive.
 
Those systems require you to blow into the device while driving. You have so much time to do it or it shuts the vehicle off. Had a fellow co-worker go through it for six months.

The funny thing is the install company in IC told him not to eat Casey’s pizza before he drove due to all the yeast in their crust which will set the device off, shut down the vehicle. LoL.

While a very faulty design, Im okay with it being a constant inconvenience to them.

Obviously this clown needs to have more severe penalties including ignition interlock to be installed in all his household vehicles, he should spend some time in prison at this juncture, and mandatory AA for the rest of his life. He has been lucky so far, first time it goes sideways everyone will scream "why didn't we do something before!"

IMO we are far too easy on repeat DUI offenders. There is no good excuse for a single offense. There is absolutely no excuse for repeat.
 
One thing for sure: the rules should be such that if a repeat offender, they should not be able to bond out. For example in this situations, he is a multiple offender out of jail and awaiting results of a previous felony DUI charge to resolve in a new prison sentence. That should never happen and they should be treated as a high risk serial killer or rapist who is an immediate threat to kill/rape again and not be released until trial is over.

Standing rule for offenders....they could not get out without a clean BAC. Pretty sure that is the standard as once they are taken into custody; the are a liability of the State

Agreed. One caveat is that it isn’t productive to have them lose their jobs. Let them do it on weekends.

Don’t they have breathalyzers that can be installed in people’s vehicles? I remember a town drunk from years ago who had to blow into one before his car would start. He also had to blow into it after several minutes of idling.

Every vehicle registered in his name he should be required to pay for a breathalyzer to be installed. Anyone who allows that man to borrow a vehicle should be charged if caught.
 
Those are just the times he's been caught. Dude should never drive again. At minimum he should be wearing an ankle monitor, though that alone won't prevent him from driving.
Just because his license is taken away doesn't mean he won't drive.
His vehicle needs to have a breath analyzer attached to his ignition.
At this rate it's just a matter of time before he causes an accident.

I knew a guy that had a half dozen DUI's and went to prison twice that I recall. The afternoon he died he was drunk again mid-morning in a small Iowa town bar and his also drunk wife somehow convinced him he was having a third heart attack(he was) so he drove himself drunk, drinking a pint of blackberry brandy for comfort along the way, to Rochester where he died that late afternoon.
 
I knew a guy that had a half dozen DUI's and went to prison twice that I recall. Died doing what he loved.
 
A friend of my wife's was killed last year when rear ended by a drunk driver who was doing like 95 mph in Daytona on her way home from her birthday party. Killed her dog as well. Her husband lived. The guy had 5 previous DUI convictions. Now he's probably going to get life, but he should have never been behind the wheel to begin with and now a nice lady with a nice family is dead.

EDIT: Also his side piece was in the car with him and she died as well.

I am not talking about getting a clean BAC. I mean not getting out again period until the subsequent trial. No bail period due to risk of harming the public. This guys should have been in jail awaiting his trial. But that was because I misread. Did not see he was on probation.

In no way condoning it, but a .32 BAC for a full blown alcoholic is pretty different than for you or I.

The dude’s baseline is probably .2.
We had an alcoholic uncle in my family, and we all used to joke, "don't let him drive sober, he won't know how!" Pretty sick joke.

Good idea about home confinement, IMO.

It's not cheap to keep people locked up in prison for years.

I liked the idea of breathylizers integrated with the vehicle ignition. But, even those don’t go far enough.

They should make the mouthpiece into the shape of a large phallus and ballz with a camera recording your vehicular BJ and posted to county sheriff website. And you have to blow AND cup to start the thing. A solid minute at least to get it started.

And no teeth!

Nope, sorry. But I am a big fan of the old style twenty dollar bill (without the big head). If he survived, D.B. would 95-100+ years old by now, if still alive. Statistically, he's probably dead... but I think he survived the jump.
