The problem I have with trump's cabinet choices is that most of them are willing to let vengeance and personal agendas rule the day. While Desanctimonious is capable of creating and governing on good policy, he has a chip on his shoulder that is very unbecoming.
Not to mention weird white boots that are very unbecoming.

This is the definition of kidnapping. Given that he and the private airline owners are being sued for their actions, the illegality is in play.

They were taken off the street in San Antonio and put on a plane. It's a little difficult to get off once they were aboard. If they were not permitted to leave, that would fit "confinement".

If DeSantis was given a cabinet position I just can't see it lasting for very long. DeSantis has too strong of his own independent personality for there not to be big clashes with Trump.
