Why are people saying Trumps convictions for fraud might/should be thrown out?

Pretty sad we even need to have this discussion of will the president leave office or not to avoid his felonies. How did America get here?

Only scared little morons are worried about him not leaving office.

He might now follow every rule in the book, but I'll place a bet with anyone right now that thinks this will happen.

The Hunter investigation happened because there was way too much visual evidence from the laptop of him doing crack with that handgun in the pictures.

They did a good job of holding off the IRS issues by letting the statute of limitations kick in.
The Hunter trial happened because Trump wanted it to happen. What he was convicted of, never even gets to trial, let alone conviction.
 
So quick question, when the judge tosses the case, he is no longer a convicted felon. Correct?
He is not presently a convicted felon. He hasn’t been sentenced, and appeals have not been exhausted. If Trump dies today, he dies as a non-convict.
 
He cheated on his wife and tried to pay off the mistress by lying about campaign funds to bury the story with the public. Let's not pretend that Trump wasn't intentional here.

This is a really odd question. No they should not be thrown out. People saying Judge Merchan might throw out the convictions. Well that is stupid and anti-rule of law since the Dumpster has already been convicted. The judge should just postpone his sentencing for 4 years or just sentence him to no incarceration time but let the convictions stick.

I mean over half of why Trump won was the 16 million fewer voters that voted for Biden who didnt even vote/take the time to go to the polls. Trump even had about 5 million fewer votes while pundits are saying "oh wow, so many people switched to vote for trump".

So no reason to vacate these convictions.

The technical answer here is that there are fair questions whether very general consumer fraud statutes were intended to be used for this sort of thing, particularly where the underlying transaction involved sophisticated and ultimately satisfied parties.

The practical one is that by upholding the conviction you walk into a constitutional crisis given his current and near term status. Often courts find procedural excuses to avoid those sorts of things.

The hard one for the court is, if they do want to say this is outside the scope of the law, how do you do it without setting a precedent that ties the hands of the ag in the future. Often these laws are sort of “last resort” tools for new types of misconduct.

I love it, the lefties just keep whining after getting their asses kicked. Let's start convicting all of the crooks like Hillary and Joe and Hunter, all of the FBI agents that brought phony intel to the FISA courts, Pelosi for her husband's illegal insider trading. All of the intel heads that lied and whatever other half-truths and arcane laws we can convict them on. Then the left may understand the absurdity of the lawfare used by the Biden administration. And free the non-violent political prisoners/patriots from Jan 6th and go back and jail all of the rioters that caused billions of dollars in damage and killed 19 in the 2020 summer riots. The next 12 years are going to be fun.
Trump already tried indicting those people in his first term or at least wanting to and even his yes man Justice Dept people said "NO THERE IS NO EVIDENCE" and the one guy was special prosecutor on Biden and everyone else and he couldnt find anything even with the precious Hunter laptop.

And where did the whole Repub impeachment thing go the last two years, no where, because Biden and the Dems didnt do anything wrong. Trump is heard trying to strong arm Zelensky which is why he got impeached.

Personally, though I think he’s a scumbag, I’d be fine with a hunter pardon. There are plenty of actual political actors to inflict collateral damage on without going after family members.

Funny thing about this, in 2014 he was one of the most revered people in the world. He put a R in his political column and he's hated by the same people that once loved him. I wonder what this would be like if he had put a D in the political column?

This in itself is puzzling. How is someone who needs to have sentencing deferred because he is president even allowed to become president in the first place?
And sadly, Trump will be the first felon in the history of this country to become president. What on earth has happened to this country?

Actually, it is very likely that the 15M Biden voters in 2020 never existed in the first place. If you look at Commies vote count it falls in line with 2012, 2016, and 2024. The 2020 vote for Biden does not fit the trend. The GOP vote over 2012, 2016, 2020, and 2024 all fit the trend. It is the 2020 vote for Biden that looks really "strange"/(fraudulent). Maybe it was to hard to throw in millions of non-existing votes when Trump had 200K poll watchers this time? Maybe those 15-20M voters for Biden in 2020 never existed?

What? I have seen that charge, working for the government, all the time. It's charged and then gets dropped because they take all those lesser charges and drop them to prosecute the federal charges that carry 25 year mandatories.

Hunter had those charges brought because the DOJ didn't want the more serious charges brought that could not be pardoned by Joe without serious outcry. When Dad wipes the slate, who cares,?
 
Any option you want to look at here is not good for democrats. Did tens of million people who had never voted in prior elections sit out because…

- Kamala was so bad, but they just couldn’t vote for her or Trump either?
- these people never existed?
- democrats only vote in historic numbers when a white male is on the ticket. Black and/or female candidates lose nearly 10% of the vote?

I am laughing all the way to the bank on this, my retirement funds increased 40K in just 2 days of the DJIA reacting to the Trump victory. Under Biden a really good day was around 3K. If a convicted felon makes me wealthier, who cares about you and your issues.
 
I hate it, but the reality is that the voters knew about Trump's crimes and voted for him anyway.

In my view, that is a de facto pardon by popular acclamation. You can't jail a guy who just won an election, including the popular vote.

Didn't hunter try to plead guilty to a lesser crime that would then give him immunity for the major crimes? The judge found this and would not sign off on it.

Washington, Jefferson and all the rest of the founding fathers were felons and wanted dead or alive by the British Government. So he's not the first felon. Thomas Jefferson was President of the southern states and was a felon and spent 2 years in prison.

So youre suggesting that his written ledger entries were created to mask hush money payments to a porn start so as to not inform the public as to their true nature. This was all done to protect his election chances and therefor election fraud? Do I have that correct? And that these crimes deserve conviction and punishment?

Serious question. Do I have that about correct? I disagree, but putting that aside for the moment, do I have my synopsis about correct and do I understand the assertions and theory of the case?
 
I'll add to that, that the DOJ will be getting a new AG and that AG may investigate the actions of the Judge in question. 🤷‍♀️
One of the candidates for it already stated he was considering 'conspiracy against rights' charges.

Those were all contrived convictions based on a stretching of the meaning of the various laws invoked.

Everyone involved knew that the purpose of bringing the cases was to create an environment where they could label him a lawbreaker and at the same time, suck air from DJT's political momentum.

This activity was the most disgraceful imaginable and was intended to create doubt along with simply forcing the candidate to spend his own money and time on nonsense. In the end they fooled no one but themselves and demonstrated that people really do see a dishonest Deep State for what it really is.

Like me? That is a first but I will bite. I am about law and order for property crime and for violent crime only. When it comes to white collar, paper work, or process crime, l think you crazy libs are going way way overboard. I would let a lot of this stuff slide... Particularly when it involves breaking bureaucrat created rules.
