Also wtf is SCOTUS doing making an emergency ruling like this? They tooks the better part of a year making rulings when dragging them out suited Trump. Now suddenly they can make rulings in just a few days when it benefits Trump? This is why trust in the court is at an all time low.

Try to get the facts straight. This is about a Justice and the President elect having a telephone conversation the same week the Court is set to decide if the President elect can be sentenced for his felony convictions.

You would have had a meltdown if Obama called Justice Kagan the week Obamacare was decided. We all know that.

So that's 2.6 billions just for Trump's daughter and son in law. You KNOW Trump made money beyond what he grifted taxpayers charging SS to stay at his properties.

This. Even fully accepting the premise that the call was essentially a reference check for a clerk and nothing else and that the former clerk asked the justice to take the call, you simply don't have that call (i) placed personally by the president, (ii) accepted by the justice, (iii) during the pendency of that case.

Side note: Alito suggests that this may have been the day before a filing was made, which if true and if you did assume the premise above, would suggest that the problem is trump and not alito.

Disclaimer: I get it that many/most won't accept the premise, which is both fine and not irrational.

Well this is hilarious. She is a member of the government in the state of Georgia. There was collusion between her and President Biden to prosecute his political opponent. As a prosecutor working for the State of Georgia she would be a part of the executive branch for the state of Georgia.

Leaving aside that he wasn’t president when the events he was tried for happened…the founding fathers did not establish presidential immunity. That is a modern interpretation of the constitution.

I dont see its application here however. The last time the Democrats had actual control all aspects of government was 2009 under Obama. That was 15 years ago.

Anticipating replies, this excludes the Biden period where the Dems had submajority control (48) due to 2 independents. We all know that these independents didnt always caucus with Dems. (Sinema)

As an attorney, I am stunned that a Justice and a person with a case before the Court had ex parte contact. I’m less stunned you think it’s no big deal.

Ex parte contact is one of the first no nos they teach you.

And a majority of Americans did not vote for Trump.

At the end of the day, here's where i'm leaning STL.

1. The call apparently came the day before the filing, and was purportedly about a former clerk in line for an administration job, so on balance, I'm not entirely surprised Alito took it. that's one of the more ordinary of DC calls. The only area of ambiguity/discomfort is that it was the president-elect on line 3 - I suppose you answer a call from the president elect, even if you thought it would probably be his minions, but you also ought to wonder why would the president call personally, but maybe the clerk gave that heads up.
2. But clearly trump knew that a filing would be made imminently. And given that, it was inappropriate and stupid for him to make that call. I suppose if you had to defend trump, you'd say (I) of course he made it before the filing, because he knew he couldn't make it after and (II) we all know that trump's an anal retentive fanatic when it comes to loyalty, so that's why he made it personally. But it's still way too bizarre -- even if Trump was smart enough not to even hint at the soon to be filed proceeding, the potential for the situation to be viewed as a quid pro quo (for the benefit of the former clerk) once it was filed is just way too high. So high that even trump would understand it, and for that reason, I tend to think that's precisely why he made it.

Perhaps we'll all get lucky and they'll just deny this thing in a one sentence order.

One funny story about ex parte contacts in the real world . Decades ago, we had a nursing home rate litigation in Montana. We had a local counsel whose last name was "Cannon". We go into a hearing with a local judge in the middle of nowhere, it goes for an hour or so. We all go out to the parking lot, chit chat with the state's counsel a bit, and at some point the state counsel leaves. At that point, Mr. Cannon turns and walks toward the courthouse and says, "ooh, there was just one more thing I wanted to mention to the judge". We got out of Dodge as fast as we could, and thereafter the local counsel's nickname was "Loose".
