It was a drunk driver who hit them right? A lot of posters condone that behavior on the OT board.
 
Like you I was really hoping she could make it back no matter how long the odds, I do think the potential for further injury likely played a part in the decision, Leg injury, Concussion etc. is serious for any player let alone someone who has gone through what Ava has.
With the TBI she suffered its just too great a risk for her to participate in a contact sport, (which basketball certainly is)......
 
It's been a bittersweet 24 hours for the Jones family out of Nickerson, Kansas...Today, Ava Jones (
@avajones_35) announced she is medically retiring from basketball after her freshman year at Iowa (
@IowaWBB). She spent the last couple years fighting hard to recover from a tragic car accident that killed her father and left her and her mom in critical condition in 2022. She'll remain on scholarship and focus on getting her degree. She told me she is interested in becoming a sports broadcaster.

Also, her brother Hunter Jones (@GorillasTrack) found out that he has officially qualified for the 2024 U.S. Olympic Trials in the decathlon. His score of 7898 at the NCAA DII championships on May 24 is the eighth highest score in the nation this year, and from what I've calculated, ninth best of Olympic Trials qualifiers.Such a resilient family, wishing them all the best.

While it is absolutely awesome to see the progress she has made and her amazingly resilient spirit, it's pretty easy to see why the decision to medically retire was made.
I cannot imagine what she's been through and how many times I would've just wanted to say "eff it!" and quit, but she just keeps digging harder. If you aren't pulling for that kid you have no soul.

Opioids (hydrocodone) according to a quick search. So definitely impaired driving. Hit them while they were on the sidewalk.
fentanyl I believe which is the scourge nationally now...I believe its 10x more potent then morphine...

"I was tired so it wasn't murder" is a crock of crap. You. Did. This. There is absolutely NO reason this person should ever see the outside of a prison (actually draw breath) ever again. You made a decision--whichever you want to claim it is--that ended a life and destroyed many, many others. You forfeit.
 
Does Kentucky define murder differently? Or why is it that he’s being charged with murder vs manslaughter in what I thought was a textbook case of manslaughter?

My GUESS is that because he killed someone while committing another felony (DWI) that it gets nudged up to murder. I would have to believe it's 2nd degree or a special vehicular designation since he didn't legally form intent for first degree, but again, that's my GUESS.

I agree 100% the SOB needs to spend the rest of his life in prison, after they shatter his knees with a baseball bat.

Below is Kentucky murder statute. I'm sure he's charged under part (b). This guy was on probation in Indiana for a drug offense. I'm guessing the jury will convict on murder for Ava's Dad. Then there are serious felony charges for what he did to Ava and her mom. Those should all run consecutive.

(1) A person is guilty of murder when:
(a) With intent to cause the death of another person, he causes the death of suchperson or of a third person; except that in any prosecution a person shall notbe guilty under this subsection if he acted under the influence of extremeemotional disturbance for which there was a reasonable explanation or excuse,the reasonableness of which is to be determined from the viewpoint of aperson in the defendant's situation under the circumstances as the defendantbelieved them to be. The goal of punishment should be purposeful removal from society with the goal of rehabilitation. Inflicting additional pain and trauma upon already violent and/or damaged people is counterproductive. The phrase 'playing with fire' comes to mind.

I thought the goal was removal from society to keep the rest of us safer. If they can rehab, so much the better .

It is, but that is automatically achieved when you remove them from society, so not really a goal at that point.
