I actually have a personal relationship with someone involved on the law enforcement side of things here. They feel good about getting Americans back in return for the work involved in the convictions.

No it isn't. A president doesn't have to pardon a prisoner to exchange them. They should still considered criminals in this country, and if they were to be found inside it again, they should face whatever remains on their sentences. In fact, they should face additional espionage charges.

In 2019, Swidan was charged with drug trafficking in China and sentenced to death with a two-year reprieve by a court in Guangdong.[2] on April 14, 2023, the Guangdong court upheld the sentence.[2] The U.S. government and the UN Working Group on Arbitrary Detention considered Swidan wrongfully detained.[2] He was released on November 27, 2024, as part of a prisoner swap with China.[3]
