We do not know ALL of them. Habeas corpus requires ALL of them be publicly identified AND they be allowed to challenge those claims before deportation. Being sent to a maximum security prison that is NOT your country of origin is NOT deportation, by its very definition

I guess my first question would be, why do you trust everything the government says? Why don't you want American court systems to handle gang members, why not prosecute them - you want to deny justice to the victims?
It's already well known that they are not just deporting those here illegally, they are deporting those here legally as well - charged with no crimes, receiving no due process. The Alien Enemies Act of 1798 has been invoked three times in history. The War of 1812, WW1 and WW2. It was last used to justify the internment of hundreds of thousands of Japanese Americans - a shameful stain on our nation's history. I must have missed something, but are we at war now? No. Are there are armed immigrants invading our country? No. There are plenty of avenues to arrest, detain and to charge criminals and gang members, why do they have to manufacture one? It's obvious, they can deport anyone they want - they don't have to charge anyone with a crime and the evidence (or lake thereof) is never revealed. Once again, if there are victims of these crimes, why would you want to deny them justice? You're against law and order? Once again, not surprised.
I'll tell you why they skate around the law - it's the same principal as being a Jew in Fascist Germany. Every government that has engaged in fascist actions throughout history either invents or changes existing law to create a legal framework to justify these types of actions. Based on history, it's the first step toward legalizing concentration camps, targeting based on race or color, whether undocumented or not. They clearly don't care.
The purpose of the judiciary branch is to interpret the constitution and the laws of the land by issuing rulings on particular circumstances. Stephen Miller knew the court order to return home was a legal one, but didn't care. The excuses they used are plentiful, but false - they know this. The conversation behind closed doors wasn't asking if it was legal or not, they were asking if they could get away with it.
I know you don't care about anything short of enjoying our transition toward authoritarianism, but those of us who appreciate America's freedoms see it for what it is. Eroding the power of the judicial branch, removing the checks and balances. Giving immense power to one branch of government and leaving the rest powerless. Here's the actual language of the statute:
§21. Restraint, regulation, and removal
Whenever there is a declared war between the United States and any foreign nation or government, or any invasion or predatory incursion is perpetrated, attempted, or threatened against the territory of the United States by any foreign nation or government, and the President makes public proclamation of the event, all natives, citizens, denizens, or subjects of the hostile nation or government, being of the age of fourteen years and upward, who shall be within the United States and not actually naturalized, shall be liable to be apprehended, restrained, secured, and removed as alien enemies. The President is authorized in any such event, by his proclamation thereof, or other public act, to direct the conduct to be observed on the part of the United States, toward the aliens who become so liable; the manner and degree of the restraint to which they shall be subject and in what cases, and upon what security their residence shall be permitted, and to provide for the removal of those who, not being permitted to reside within the United States, refuse or neglect to depart therefrom; and to establish any other regulations which are found necessary in the premises and for the public safety.
What is in red has simply not happened, and ergo the President has no authority to use this statute. Only Congress can declare war - this Act was not even used by Bush after the 9/11 attacks, because no "government" or "nation" had attacked us.
AND:
§23. Jurisdiction of United States courts and judges
After any such proclamation has been made, the several courts of the United States, having criminal jurisdiction, and the several justices and judges of the courts of the United States, are authorized and it shall be their duty, upon complaint against any alien enemy resident and at large within such jurisdiction or district, to the danger of the public peace or safety, and contrary to the tenor or intent of such proclamation, or other regulations which the President may have established, to cause such alien to be duly apprehended and conveyed before such court, judge, or justice; and after a full examination and hearing on such complaint, and sufficient cause appearing, to order such alien to be removed out of the territory of the United States, or to give sureties for his good behavior, or to be otherwise restrained, conformably to the proclamation or regulations established as aforesaid, and to imprison, or otherwise secure such alien, until the order which may be so made shall be performed.
This is the due process element REQUIRED by the statute, explicitly. ONLY a judge can approve the removal or incarceration of the "foreign enemies" - NOT any Executive Branch official. The statute is crystal clear on this procedural aspect - it is not a "close call" here.
