Ethics Complaint Rocks Capitol: Pelosi, AOC, and Dems Accused of Misusing Funds

An ethics watchdog has filed a complaint against 10 Democratic lawmakers, accusing them of using public resources for partisan political purposes.

The Foundation for Accountability and Civic Trust (FACT) claims that the legislators repeatedly used official resources for political gain, including government buildings, official websites, and social media accounts.

The complaint includes examples such as using House video on a campaign website and re-posting official social media posts for political purposes.

“The law at issue is simple,” the release noted, adding that federal resources are not to be utilized for “campaign or political purposes.”

“The rules additionally reiterate that campaign social media accounts cannot contain any official content or resources and cannot re-post official social media posts,” the release said.

“These violations are rampant and obvious, and clearly the OCE’s failure to act has encouraged continued violations. This failure has also incentivized these Members to use House proceedings for political campaigning rather than doing what is in the best interest of the country,” FACT Executive Director Kendra Arnold said.

“Likewise, it is also clear why these Members are doing this, it’s for a political advantage and one that is paid for by the taxpayers. The OCE has both the authority and a clear responsibility to ensure each ethics violation is dealt with swiftly. Not doing so both permits clear violations to continue and erodes the public’s trust in the OCE itself,” she said.

FACT alleges that the Office of Congressional Ethics has failed to address these violations, allowing lawmakers to continue without punishment, thereby eroding public trust.

“Currently, numerous Members are using official House resources for political purposes and are doing so both repeatedly and publicly,” FACT wrote.

“The law quite clearly forbids this, yet a handful of Members continue to do so. The most obvious violations are Members using official government resources to campaign on their political social media accounts or using official government platforms to campaign,” the letter read.

“The failure to address this egregious practice has permitted these Members to continue committing violations to this day with impunity. Though to some it may seem like a simple thing on the surface, the Members choosing to break this law do it for a reason — it advantages them politically,” the letter added.


“Not acting upon obvious violations not only permits them to continue but it erodes the public’s trust,” the complaint read.

“In fact, these Members’ campaign social media accounts demonstrate that they consistently use official resources for political purposes and have used numerous different types of taxpayer-funded resources for their political campaigns,” it said.

“For instance, the examples previously provided to the OCE and the attached examples include every type of official resource identified above: use of official House photographs, official House floor and committee proceeding videos, official House work product and press releases, government buildings, and re-posts of official House social media accounts for political purposes,” the letter read.

Overview​

The conservative group Donors Trust was the source of $500,000 of FACT's revenue in 2015 and $800,000 in 2016.[7][8] As a 501(c)(3) organization, FACT is not required to disclose donors; however, Charles Koch has acknowledged giving to DonorsTrust.[4] FACT paid Whitaker $1.2 million, with the vast majority of the payments from 2016 to 2017.[9][10]

FACT has largely focused on Hillary Clinton[11] and the email scandal,[4][12][13] and other Democratic representatives such as Senator Evan Bayh of Indiana, Representative Patrick E. Murphy of Florida and Representative Ted Strickland of Ohio.[14][15] FACT lobbied against the confirmation of one-time Supreme Court nominee Merrick Garland, and filed an FEC complaint against Democratic voter data firm Catalist in 2015.[8] Despite claiming to be nonpartisan, the organization called for ethics investigations into or filed complaints about forty-six different Democratic politicians, officials, and organizations, compared to only a few Republicans.[16] During his tenure, Whitaker wrote opinion pieces that appeared in USA Today and The Washington Examiner, and appeared regularly on conservative talk-radio shows and cable news.[17] In 2017, Whitaker (as executive director) wrote:[18]

In addition, FACT filed a complaint in August 2017 with the Federal Election Commission (FEC) against the Democratic National Committee (DNC) and Alexandra Chalupa, a consultant working for the DNC who had been investigating Paul Manafort and Donald Trump's ties to Russia.[19][20] Whitaker made the complaint at the direction of the White House.[21] FACT acted in close concert with Senator Chuck Grassley, who also made a complaint with the DOJ. FACT's complaint was based on the claim that Chalupa had met with Ukrainian officials in an effort to expose ties among Trump, Manafort, and Russia.[22] As of December 2018 the FEC had given no indication whether it would investigate the issue.[23] Chalupa denied any wrongdoing.[24]

In 2016, Whitaker defended ExxonMobil as the executive director of FACT when the Attorneys General United for Clean Power Coalition started their investigation into the firm for not disclosing climate change risks.[25] Whitaker called the investigation "both unconstitutional and unethical".[25] The investigation has since matured leading to four counts of fraud being filed against ExxonMobil.[26][27][28]

In 2018, FACT scrutinised a pro Rick Scott Political action committee.[25]

FACT has paid outside Republican firms to perform some of its work. One such firm is America Rising LLC, which was given $144,000 for research in 2015.[29] FACT paid America Rising at least $500,000 for research from 2015 to 2017.[30] FACT also had close working relationship with America Rising, sharing information and political communication strategy.[31] The foundation last year paid $134,119 to Creative Response Concepts, a conservative political public relations company and has paid a total of $500,000 to the agency.[30]

Some experts such as Daniel Borochoff, president of CharityWatch, have questioned the status of FACT, saying that the organization may have violated its tax-exempt status.[7][32] FACT has called for ethical investigations or filed complaints against over 46 individuals or organizations, the vast majority of whom are either Democrats or associated with Democratic causes.[15]

This "report", at best, it just ammo for mudslinging. Nothing will come of it but it will give right-wing media something to crow about.

Nothing will come of this, and I bet you could hit about 40%-50% of DC politicians with "misuse of funds" charges.
I would guess that the percentage is a LOT higher. I'd certainly be in favor of holding them all accountable for rules/laws they've broken - as well as extending laws that would apply to the rest of us - like insider trading laws.

The DC gravy train is very powerful. It’s funny to think billions of dollars are at stake for both parties and we the people are dumb enough to believe people aren’t trying to steal elections.

This report is pretty short on specifics. If specifics in this case are unique to these lawmakers I think it’s a story. Knowing politicians, it’s not unique to Democrats if true. It’s interesting that they charged high profile democrats exclusively.

So, I’m going to need just a bit more info before I hit the outrage button.

"FACT is a much newer creation, organized in 2014 as a conservative counterweight to watchdog groups viewed as more left-of-center, such as Citizens for Responsibility and Ethics in Washington. The newer outfit took its first public action about a year ago when it filed a complaint with the Federal Election Commission against Democratic voter data firm Catalist.


Since then, FACT has, on rare occasions (possibly just once), gone after a Republican, but most frequently accuses Democrats — particularly frontrunner and former Secretary of State Hillary Clinton — of ethical or legal violations.


Its funding — $600,000 in 2014, according to the only tax return it has filed to date — comes entirely from a conservative donor-advised fund called DonorsTrust, which means it could come from anywhere. DonorsTrust is a pass-through vessel that manages the charitable contributions of wealthy individuals and foundations to organizations that are “dedicated to the ideals of limited government, personal responsibility, and free enterprise,” according to its website while allowing the donors to remain anonymous. Charles Koch is among the many conservatives who have filtered money through DonorsTrust.


In other words, an organization “dedicated to promoting accountability, ethics, and transparency” gets 100 percent of its funds from a group that exists mainly as a vehicle for donors to elude transparency."

I’m fairly sure I saw political ads before the Iowa caucus that used footage that is apparently not allowed.
