New York high court to determine if Bronx Zoo elephant is a person

Note that Happy the Elephant is not the plaintiff here. It is NhRP. Why does that matter? Because NhRP is invoking the writ of habeus corpus (an order to produce the body). Stated slightly differently, Happy is not engaged in some fight for elephantine freedom. Rather, NhRP is engaged in a battle to be Happy's new slave master, on the basis of Happy's (supposed) elephantine freedom. But Happy is still just a chattel. NhRP should have to pay attorneys' fees for this spurious litigation under whatever New York's version of Rule 11 is.
 
Happy was born in the wild in Asia in the early 1970s, captured and brought as a 1-year-old to the United States, where she was eventually named for one of the characters from "Snow White and the Seven Dwarfs." Happy arrived at the Bronx Zoo in 1977 with fellow elephant Grumpy, who was fatally injured in a 2002 confrontation with two other elephants.


So if the court finds this elephant to be a person, will those other two elephants be charged with murder?
 
Animals are just dumber different looking "people." Animal rights will become a big thing in the future. Why should we have a right to put something in the zoo just because we're more clever?

I think it all boils down to the idea of speciation and what it means. I don't think it means anything, ultimately. All forms of sentient life need equal respect.
 
It's weird that a living creature gets eye rolls and "this is crazy extremist stuff" when it's status as a living, thinking being is brought up but when corporations want to be treated like a person (at least in cases where it helps them, not when it is inconvienent) these same people eye roll give an enthusiastic "Yes sir!".

I don't really have an opinion on this specific case but at least an elephant needs food and water to survive, can make babies, and shows empathy. None of which a corporation does.

Sounds like a self defense or manslaughter issue.

The case asks the court to elevate animal's classification under the law above something more than chattel. Most people don't realize that when Fido dies in a fire, that they don't get the sentimental value for the pet.

A corporate entity is a legal shield for those who create/operate it.

It is created by and maintained by people to satisfy a legal and societal need.

It has nothing to do with animals. That's a ridiculous analogy.
You just described two ways a corporation is not a person. You're right, corporations have nothing to do with living things which is why they aren't people.

You just described two ways a corporation is not a person. You're right, corporations have nothing to do with living things which is why they aren't people.

When Mitt Romney famously said, "corporations are people" he didn't fully appreciate the fact that some Americans (mostly on the left) don't understand that the vast majority of corporations are basically just another name for the rich guy who owns the company.
