Sports Gambling Update

If it ever comes out, it would be fascinating to learn his background and the reasons why he chose to target the athletes. Playing an amatuer psychologist here I am going to venture a guess he may have been a frustrated athlete himself and never quite good enough. Maybe he got pushed around a bit in high school? Or maybe he is just an ultra do gooder who sees the law as black and white. Not sure I buy the fact he was simply concerned about the fixing of games, however.
 
So translation this guy not only screwed up a bunch of young men's lives and screwed up sports seasons that we enjoy but now we as taxpayers are likely going to have to foot the bill for the millions that this is going to cost in lawsuits because all of these people had there privacy illegally invaded. This guy defiantly should take the title for the most hated state employee named Brian now!
 
I’d assume it comes down to if he actually needed a warrant to do the surveillance that he did? I’m not an attorney, but there are many things the government can legally monitor without a warrant. I’m certain online sports gambling is one of them.

Yes, they do have the legal authority to monitor the providers of gambling and the industry in general - such as the casinos, casino employees, etc. But they can't just randomly choose to investigate private citizens without reasonable suspicion/probable cause.

He is a DCI agent with layers of authority above him. There is no goddamn way he conducts this type of investigation without the consent and sign-off from DCI upper level officials.

More importantly, charges are filed by the Attorney General. Was the AG satisfied that evidence was gained legally? The buck stops at the AG's office. The DCI makes recommendations only.

Reasons he can’t explain? Hmmm. “Well gee sir, I was in the shitter one day where some of my best ideas come to me and I suddenly got worried about college students and gambling…”

Here’s the thing about this process. They got account numbers from non targeted, non athletes because they “geofenced” a dorm that is known
to have freshman athletes. I wonder if due process or privacy laws don’t apply to students living in government housing? A lawyer is going to have to plain speak this to us. Of course, this is all based on what the defense lawyer has put out.

But yea, potential law suits can be huge. A buddy me reminded how the state auditor got after Barta on the law suits. Wonder what he’s thinking now?
