Now I understand your confusion.
Giuliani's lawyer obtained a copy of the laptop's hard drive, not the laptop.

It was seized by the FBI pursuant to a grand jury subpoena in December of 2019. You can see that in the link I posted to the New York Times earlier in the thread.
