DeSantis Suspends Second Elected Prosecutor in Florida

Gov. Ron DeSantis of Florida suspended the top state prosecutor in Orlando on Wednesday, accusing her of incompetence and neglect of duty for what he characterized as lenience against violent criminals.
Mr. DeSantis suspended Monique H. Worrell, the elected state attorney of Florida’s Ninth Judicial Circuit, which includes Orange and Osceola counties, and cited her handling of three cases. One involved a man who shot and injured two Orlando police officers over the weekend.
It is the second time in a year that Mr. DeSantis, a Republican running for president, has taken the drastic and exceedingly rare step of removing an elected state attorney. Both have been Democrats.
Mr. DeSantis was heavily criticized in August 2022 when he removed Andrew H. Warren, the top prosecutor in Tampa, who had signed a statement along with 90 other elected prosecutors across the country vowing not to prosecute people who seek or provide abortions. Critics, and even a federal judge, blasted Mr. DeSantis’s ouster of Mr. Warren as politically motivated. But Mr. Warren remains out of office — and Mr. DeSantis mentions his removal in just about every campaign stump speech.

On Wednesday in Tallahassee, Mr. DeSantis said that Ms. Worrell’s office had avoided seeking mandatory minimum sentences for gun and drug trafficking crimes; allowed juveniles to avoid serious charges or incarceration; avoided seeking more serious sentences when they were available; limited charges for child pornography; and inappropriately allowed some offenders to avoid having a criminal conviction on their records.

“Prosecutors do have a certain amount of discretion about which cases to bring and which not,” he said. “But what this state attorney has done is abuse that discretion and has effectively nullified certain laws in the state of Florida.”

Ms. Worrell, who was elected in 2020, was known to be in Mr. DeSantis’s sights. He criticized her office earlier this year, and his general counsel sent her a letter seeking documents about previous arrests. Mr. DeSantis is a former federal and military prosecutor.
In March, anticipating that she might be suspended, Ms. Worrell released data showing that her prosecution rate was similar to that of her predecessors. In an interview at the time, she warned of the dangers of a governor pushing the boundaries of his executive power to remove law enforcement officials who belong to the opposing political party.
“This could flip any day — we could get a Democratic governor who then decides to go around suspending all Republican prosecutors because we are not in alignment in ideology,” she said. “It has to stop. This is a dictatorship. This is not a democracy.”




Ms. Worrell and Mr. Warren were among many prosecutors who have been backed by groups supported by the liberal billionaire investor George Soros. Mr. DeSantis uses derisive mentions of Mr. Soros’s name to draw cheers as he campaigns for president.
“We have stood for law and order in the state of Florida,” Mr. DeSantis said last week in Cedar Falls, Iowa. “And when we had a Soros-funded left-wing prosecutor in Tampa saying that he wasn’t going to enforce laws that he didn’t like, I removed him from his post.”
In suspending Ms. Worrell on Wednesday, Mr. DeSantis did not discuss Mr. Soros. But as with the removal of Mr. Warren, right-wing commentators online emphasized the Soros connection to Ms. Worrell, and members of Mr. DeSantis’s campaign amplified that message.

The federal judge in the Andrew Warren Hillsborough County SA case ruled that Meatball violated the law when he removed Warren from office. The judge also ruled that he didn’t have the authority to order his reinstatement and urged him to appeal to the appellate court in Atlanta. I haven’t followed the case since to see if Warren filed an appeal or if he is simply going to win the seat back in the next election.

He violated the Florida constitution not the law which makes it worse IMO.
 
DeSantis jumped the shark awhile back. Everything good he did during Covid is being outweighed by his arrogance and authoritarianism now.
He’s been authoritarian for a couple of years ago. I’ve only said it a dozen times. If someone does something he doesn’t like he comes at them. There isn’t compromise with Ron. His way or he will use his power to attack.

Meatball has made some horrible decisions since taking office, and many more recently. But this one is a little different. Don't get your panties in a wad yet. The neighborhood these crimes happened spearheaded this.

I understand that point, but can folks complain about gun violence in an area of the prosecutor isn’t enforcing the gun laws. Why wouldn’t you want the prosecutor to charge felons for possession of an illegal firearm? It only makes things worse

It's concerning but I don't trust GOP facts either. She should pay at the ballot box if true.

He has the power. but the big question is, did he abuse it? There certainly may be some truth to the allegations, but I have a feeling we are not seeing the whole picture. A couple of things stick out: all of the information in the allegations came from Osceola County, none from Orange County, which is a much bigger county. DeSantis had two Sherriff's at his press conference, but neither was from Orange or Osceola County. Also, I would like to hear what the Chief Judge for the Ninth Circuit has to say about the performance of the State Attorney, and has he and his fellow judges been critical of the charges brought to them by the SA. I would want to see a lot more information before passing judgment on the SA. Unless she is just totally incompetent, I think it should be up to the voters in those two counties to determine if she should still be the SA during the next election.

That ruling was so stupid. The federal judge was just lashing out because he had to dismiss the lawsuit even though he didn't like that outcome.

And determining whether the state constitution was violated is a matter for state courts, not federal courts.

Let's pretend this is true, I can't read the article, but this opens a potential future Dem governor to override the will of local voters. She ran on a platform, and appears to be fulfilling it. Do you have any articles about any criminals in red parts of Florida causing chaos? Should those prosecutors be removed by DeSantis?

Orange-Osceola State Attorney Monique Worrell is defending against accusations from police union officials who say her office should have done more to keep Daton Viel, the man accused of shooting two Orlando police officers on Friday, behind bars when he was arrested earlier this year.

After a manhunt, the 28-year-old with a lengthy criminal history was killed by an Orlando SWAT team Saturday morning while barricaded inside a local hotel, OPD Chief Eric Smith said.

“Daton Viel was a violent criminal that the Orange/Osceola County State Attorney let walk the streets after Orlando Police arrested him in March of this year for sexually assaulting a child,” a statement posted to the Fraternal Order of Police Orlando Facebook page said. “He was on probation at the time of his arrest, yet Monique Worrell let him out. Now 2 Orlando Police Officers’ lives have changed forever. Monique Worrell’s soft on crime stance has yet again let the citizens of Orlando down.”

Remember Sheriff Greg Capers, who let Francisco Oropeza wander around Cleveland, TX, despite enough to lock him up? Why hasn't Greg Abbott purged that local official?
