Maine Removes Trump From Ballot

Anyone have an inkling of how many other states are going to follow suit on this?

Oh, and on what grounds would Texas remove Biden from the ballot?
They don’t have any grounds for removing Biden from the ballot. That’s the entire point. They want to make Trump’s removal look political. In their mind, the way to do that is to take a purely political action against Biden to make it look like the whole thing is part of a political tit-for-tat. They either don’t realize or don’t care that only Trump ballwashers are dumb enough to fall for it.

I already supplied the reasoning. Biden has a constitutional obligation to protect all US citizens from invasion. He's failed and violated his oath of office. This is actually a stronger legal theory then pointing to the 14th ammendment which specifically does not list the president of the United States in it even.

Also, they're moving to impeach this broad now. Would be hilarious if she gets impeached and scotus inevitably strikes this down anyways.

I think TC was making a point that someone just because they are popular doesn’t exempt them from the rules. Be election, legal, ethics, etc. Most likely too nuanced for HROT though. I don’t agree with it in this case. Feel it should be up to the courts and not an elected official.
 
Thankfully in America we let the Supreme Court decide what's consititional and not an anonymous internet poster named ping.
Wtf is consititional?

I will admit I was asleep during most of law school but I'm pretty sure I didn't take that class.

Reminder that the last republican the dems chose not to include on the ballot in their states was Abe Lincoln. Not a great record tbh

Maine is following Colorado’s lead. I wonder if there will be others and if each one might word their rulings a bit differently so that at least one is either upheld or SCOTUS refuses to even hear certain cases and thus they stand?
If SCOTUS follows their own precedent in leaving States alone to manage their state-run election (primaries) processes and interpret their state constitutions, as the Court did with the Gerry-mandering cases and some others, I believe, then they should refuse to take on these cases as well.

A decision by SCOTUS to selectively apply their prior rationale and cherry pick certain cases to benefit Trump will only further undermine their legitimacy.

People don't get to decide to vote for someone who isn't qualified.

Well, if we're being honest.

When a all D appointed supreme court in Colorado and D Attorney General in Maine toss him from the ballot....it's understandable it might look that way to folks.

If and when the SC tosses the Colorado decision I'm pretty sure the 6-3 R majority will be brought up ad nauseum.

Let’s say that Maxwell Frost wanted to be president and ran in 2024. Should the people decide his fate at the ballot box? Of course not. He is 26 years old. He isn’t eligible. Someone somewhere would have to make the decision that he has to be removed.

Same thing for Trump. If he supported insurrection or rebellion he isn’t eligible. The voters do not get to decide that.

The only way I even thought of that reply is that previous posts on THIS BOARD by many others who know him have provided a lot of info about his issues.
Combined with his off the wall positions and posts and I’m not the only one who could have made that remark or one similar to it.

I’m all for this if it means Trump won’t be the nominee but why not wait until you know Trump is convicted of a crime before removing him from a ballot? Certainly the left can see the argument from the other side right that this all politically motivated? There are many leftist commentators arguing the same point.

 
I read the legal affidavit this AG filed. If you read page 5, you will see it's only a political stunt on her behalf. This will take a few days to be overturned. The 5th page completely crapped on all laws.
