Supreme Court sets Trump immunity claim in D.C. trial for April 25

The Supreme Court has scheduled argument for April 25 to review Donald Trump’s claim that he is immune from criminal prosecution on charges of trying to overturn the results of the 2020 election.
The case will be heard on the final day of the court’s argument calendar and will determine whether and how quickly Trump faces trial in D.C. for allegedly trying to block Joe Biden’s election victory. The high court’s decision to consider Trump’s claims, rather than letting stand a lower court decision that he can be prosecuted, drew criticism for further delaying the election obstruction trial. It was originally scheduled to begin this week.

The former president, who is on the cusp of securing the 2024 Republican nomination, has tried to push the D.C. trial and others he faces until after the general election. If Trump is reelected, he could try to order the Justice Department to drop the federal charges against him. In addition, it is Justice Department policy not to prosecute a sitting president.

Last week, the justices announced their plans to consider the unanimous ruling from a panel of the U.S. Court of Appeals for the D.C. Circuit, which rejected Trump’s sweeping assertion of immunity from prosecution. On Wednesday, the court set oral argument for April 25, adding another day to its calendar.

Trump’s pretrial proceedings in D.C. remain on hold until a ruling is issued. The high court could decide the matter at any time after argument and almost certainly will do so before its term ends in late June or early July, most likely pushing any D.C. trial into the second half of the summer or the fall.



The justices have shown they can move quickly. They took less than a month to issue a unanimous ruling Monday that keeps Trump on the ballot and reverses a Colorado opinion that disqualified him from returning to office.

Whatever the court decides in the D.C. immunity case could also have implications for Trump’s other legal troubles. Trump, who has pleaded not guilty in all four of his criminal cases, has raised immunity issues in his federal case in Florida, where he is charged with illegally retaining classified materials after he left the White House and obstructing government efforts to retrieve them.
Trump has also brought up the issue of presidential immunity in Georgia, where he faces state charges for allegedly participating in a massive conspiracy to undo the 2020 election results in that state.
His fourth indictment comes from New York, where he is scheduled for trial starting later this month on charges of falsifying business records to cover up a hush money payment to an adult-film star during the 2016 election. It will be the first criminal trial of a former president — and the first criminal trial of a leading presidential candidate.

 
So an opinion around end of June. Followed by rescheduling hearings. Yeah no way the trial happens before November.
 
It didn’t take the SC very long to call off the count in Fla and award the Presidency to Junior, either. They can move however quickly “they” want to move…….

That's entirely the reason why they want the trial in before the election. So people know what they are voting for. But of course you already know that. Well, maybe you don't, but you should.
 
I assure you, they do not. They absolutely should, but they don't. They live in a world of denial and conspiracy.
I mean, it's so hard for me to reconcile this. They have to know, even though if they somehow have gotten themselves to believe something else. Like how they have convinced themselves that the economy was great under Trump. They have to know that he lost more jobs than any other President during his term, right? But they just really, really pretend the outcome was different? They have to know that there were millions of unnecessary deaths because of how badly they bungled the response to it?

Abby….did you watch the events unfold on 1/6? Did you listen to McConnell a month later condemn President Trump and declare that he was not “above the law” in a speech on the Senator floor? The ballot access thingie has already been decided. So are you saying that anybody who gets the Republican nomination for President is literally above the law (I'm sure the same standard doesn't apply for Democrats)? That if any criminal trials involving a Republican nominee for President (of course not for Dems again) go forward in the months before an election that that's somehow anti-Democracy?

To an extent you’re right; but don’t forget the SC was asked to take up this question in December, said no and then agreed to take it up after trump appealed the district courts ruling. Then they don’t schedule it until the end of April.

That’s an unnecessary 5 month delay here that’s entirely on the SC

He's certainly a big contributor, that's for sure. But there are many people involved. The only question I have is if it was intentional by Biden so he could appear to be investigating it while at the same time not being such a huge distraction that he wouldn't be able to get anything else done or if Garland was just the wrong guy. I actually think this was a more strategic decision. Plus, the gamble is they may not have been concerned about actually having a verdict by the election, but for Trump to have to be dealing with trials during the entire campaign will not only drain him of funds, it will put everything he did during his first term front and center right before the election. It's a fine needle to thread and we will see if it works.

I was very confident that it would be highly successful but this Hamas/Israel thing is a wrench. It's almost as if someone knew that this type of conflict would throw elements of the left into chaos and take a significant chunk out of the Democratic voting base, because no matter which side the Democrats support, somebody is pissed off. How long did Netanyahu know about this without doing anything? I'm not saying anything is connected, I'm just asking questions here! ;)

What you said is all very true. This is different circumstances though.
Why? A man running for election for POTUS who is facing 91 criminal counts is claiming he has absolute immunity…with multiple trials pending due to this appeal.

With the election just months away this seems like a good time to expedite. We know they’re capable of moving quickly when they want to.

The one thing I've maintained all along...in terms of what DJT's legacy will be, the longer term of his SCOTUS appts. All three are relatively young and could very well be Justices for >25 years.

The majority of the Republican Party, MAGA/Putin lovers, say they will vote for Trump even if he's a convicted felon. So why do you care if there's a trial before the election or not.
