So there’s two factors here: 1) the order has to be lawful (accompanied with a warrant, court order, etc) and 2) the commissioner can let the party know about the request.

The DOJ filed a civil lawsuit against NY, its governor, and AG - these are not criminal charges. DOJ is trying to force NY to turn over info on people illegally present in the country and to enjoin the enforcement of NY's laws on the topic. The courts will decide.
