If they can reasonably accommodate her religious beliefs, current law says that they have to provide accommodation.

Other than removing her from office, there really is no "accommodation". She has a sworn duty to uphold the law. She refuses. She should face escalating financial penalties and civil lawsuits for refusing to do her job.

Her attorney suggested a rather easy accommodation. It seems in this state the marriage licence is issued under the authority of the clerk with her name on it. She apparently would be fine issuing a licence under the authority of the state with the Governor's signature or the like.

Maybe I'm confused by your post, but it doesn't sound like that is a possible accommodation. If the law requires the clerk's signature...you can't just use the Governor's signature.

Maybe the Gov should just issue them himself? Does he have authority?
 
Just to play devil's advocate... OP said "GOP voter". Could he have meant that her stance gives us reason to believe that the lady's view means she would vote for a Republican because Republicans think they have the moral authority to make such a decision?

Regardless... just another reason to dislike Kentucky, imo.

Fines probably aren't going to be very effective. She'll just set up a GoFundMe page and people across the country will send her money to help pay the fines. They need to just fire her for dereliction of duty and end this circus.

Presumably there is no reason the law which may even just be an executive regulation can't be amended to accommodate. Frankly they could just close the clerks office and replace it with a website for the whole state. This whole process seems archaic and without value.

That has been my point in questioning what her beliefs are actually interfering with. Her job as a clerk is to simply verify the applicants information and stamp it, such as their names, dates of birth, and whether they are already married. She isn't "authorizing" their marriage, the state doesn't give her authority to say yes/no, only to validate the information.

There isn't any discretion involved. A website could, in theory, take care of it, but that information still needs to be verified.

Regardless, REGARDLESS, the government can not violate the Constitution or peoples' rights. She is the government. She does not get to substitute her personal beliefs, religious or otherwise, in to the situation. There is no accommodation need, or even discussion. That much needs to be made clear.

It sounded different when I heard her attorney on the TV. There is some "authorized by" signature line that the clerk must sign. She doesn't want that responsibility. Apparently in some other states that line is more general as in "authorized by the state of Iowa." So for the price of a piece of paper the Governor presumably could amend the form the clerk uses to verify the info.

I'm with you that this is crazy, I'm just pointing out there is a fairly painless way forward where everyone could win. Its good to be versatile.

I would be impressed if the Quran had a rule about driving at all. Interestingly enough there are those who claim the holy book predicted all sorts of modern scientific facts. So it's not inconceivable God told Muhammad about the Audi R8 which if it finds its way into my driveway would be proof of God's divine power.

I agree with natural if there is some sort of generic form not needing a signature from her it might be a fix
