I don't know anything about the Washington situation, but anyone in possession of child pornography (any person under 18 depicted sexually) is guilty. It doesn't matter if the person in possession is also under 18. It's illegal.
I know of a specific case where a young man (under 18) had naked pics of his girlfriend (under 18) on his phone. His girlfriend just happened to be the daughter of the county attorney.
He got sent to Woodward Academy and was placed on their sex offender floor.
